Re: 9/15/2026 Agenda Item 3.3: Detention and Custodial Facility Moratorium Dear Mayor Mahan and Councilmembers,
We strongly support the proposed moratorium on applications for human detention or custodial facilities.ICE’s effort to build a detention facility on Holsclaw Road in unincorporated Santa Clara County shows that the threat of such facilities in our region is real. Since San Jose has not previously evaluated whether its zoning regulations adequately address detention, holding, or processing facilities or whether additional land use standards governing the location and operation of such facilities are appropriate, a moratorium while this analysis is going forward is both appropriate and prudent.
In addition to the serious moral and humanitarian issues of ICE detention facilities under the policies of the current federal administration, the potential impacts to the environment could be significant. The ICE facility at issue on Holsclaw Road is a dramatic example. As detailed in our amicus brief to the court in the lawsuit by Santa Clara County and the State of California, that facility could have impacts ranging from wildlife movement and water quality to the viability of local agriculture..
We urge the City to ensure that the framework to be developed by staff to address detention and custodial facilities includes considerations of impacts to the natural environment. In particular, we are concerned that a potential ICE detention facility in Coyote Valley or other open space within City boundaries could have severe consequences for wildlife, flood risk and water quality, and agriculture.
The fact that ICE chose the Holsclaw Road site for a future ICE facility is indicative of the potential threat to Coyote Valley. Like the Holsclaw Road site, Coyote Valley is an agricultural area with relatively low land appraisal values. Its proximity to Highway 101 and Monterey Road while still being rural enough to escape the watchful eyes of neighbors makes it vulnerable to being targeted for an unpopular use such as an ICE facility. r=]green W foothills

While the Sept. 1 memo from Lee Wilcox references the potential for a detention facility to be proposed in a Heavy Industrial zone, it does not mention the vulnerability of Coyote Valley for this purpose. And yet, the cases from other states described in the memo where proposed ICE facilities lacked access to water and sewer infrastructure – leading to ICE representatives suggesting problematic solutions such as trucking water in and trucking sewage out – are more likely to arise in areas outside the Urban Service Area such as Coyote Valley.
We urge the City to ensure that the framework to be developed by staff to address detention and custodial facilities considers the potential for ICE to attempt to construct such a facility in Coyote Valley or elsewhere outside the Urban Service Area.
Thank you for your consideration of these comments.

Although I am not an immigrant, and do not appear to be the populations that are being racially profiled, ICE is corrupt and brutal. They are dragging people from their homes and cars and wrecking havoc in our communities. They are not targeting criminals, but are racially profiling the types of immigrants that Trump doesn't like, specifically people of color and people with accents (ironically, he seems to be OK with immigrants like his supermodel wife and her family).
The reality is that no one is safe when leaders and departments are corrupt and self seeking.
Anyone who thinks "ICE is just coming for 'illegals,"'will learn the hard way just like people thought they would be safe in occupied countries in Europe when the government was rounding up people who were Jewish, people of color, LGBTQ, or anyone who was different.
No one is safe with a corrupt government and it's corrupt departments like OHS, the DoJ and ICE.
The City should exercise its legal authority and responsibility to protect the public safety and health of all its residents.

I am concerned of the fact that our friends, family members, and neighbors are being abducted by ICE agents without due process and thrown into ICE detention centers that are inhumane in and around surrounding counties of San Jose. We need to stop trying to duplicate El Salvador's/Bukfele's CECOT fascist tactics of snatching innocent people off the streets only to help the Trump administration to score political points and to instill fear within our neighborhoods, especially within our BIPOC and farmworker communities. San Jose is better than this, as our social fabric is built off the the backs of immigrants and migrant workers.

This matters to me deeply because I want my community in the South Bay to feel safe, and that includes the vibrant immigrant families who make this area so unique and beautiful. Silicon Valley would not be what it is without immigrants. ANY attempt at a detention center in ANY part of our area would be devastating to hundreds of thousands of people. ICE cannot be allowed to begin high volume raids like they've illegally done in LA.

This matters to me, because I am a descendant of a family, American citizens, who were unjustly incarcerated into prison camps during WWII solely because of the color of their skin - with no due process. Dear Mayor Mahan and Members of the City Council:
I am writing in support of Agenda Item 3.3, the proposed 45-day temporary moratorium on applications involving detention and custodial facilities on private property.
Immigration enforcement is a difficult and emotionally charged national issue. My comments are not intended to condemn individual employees, debate particular enforcement cases, or suggest that the City can override lawful federal authority. The narrower question before the Council is whether San Jose should approve private-property applications for detention or custodial facilities before determining whether its existing land-use regulations adequately address this unusual type of facility.
A temporary pause is a reasonable and measured response.
The City's zoning code does not currently define detention and custodial facilities as a distinct land use. According to the staff memorandum, an undefined use would presently require a conditional use permit and would be limited to a Heavy Industrial zoning district. That default treatment may not adequately account for the operational characteristics of a facility in which people are confined, processed, transported, housed overnight, or provided with medical and legal services.
Heavy Industrial districts may expose medically vulnerable individuals and other occupants to noise, vibration, pollution, heavy machinery, truck traffic, and other conditions that would not ordinarily be evaluated for a custodial residential population. At the same time, a detention facility could place demands on roads, water, wastewater systems, emergency services, law enforcement coordination, and surrounding properties that differ considerably from those of a warehouse, office, or conventional industrial operation.
The proposed moratorium does not permanently prohibit these facilities. It preserves the status quo for 45 days while the City begins developing an appropriate regulatory framework. The ordinance also requires nine affirmative Council votes, ensuring that an interim restriction of this kind receives broad support.
The measure is also carefully limited. It applies to detention and custodial facilities operated by private or nongovernmental entities on private property. The City Attorney's supplemental memorandum explains that the City cannot directly regulate state or federal governmental property in the same manner because of state-law and federal constitutional limitations.
The ordinance contains exemptions intended to prevent unintended interference with legitimate services, including certain juvenile rehabilitative and educational programs, court-ordered treatment and evaluation services, medical or vocational services provided to people in custody, licensed residential-care facilities, school disciplinary facilities, public-health quarantine facilities, and facilities used to carry out sentences imposed by a court.
These limitations are important. They help distinguish a temporary land-use review from an overly broad prohibition that could interfere with treatment, healthcare, rehabilitation, education, residential care, or other necessary services.
There are several practical reasons to approve the moratorium.
First, the City should define this land use before it receives an application. Once an application has been submitted under existing rules, the City may have less flexibility to establish standards addressing location, capacity, infrastructure, compatibility, and operating conditions.
Second, a detention facility can create infrastructure demands that should be evaluated before a site is selected. Depending on its size and operation, such a facility could require substantial water and wastewater capacity, employee and visitor transportation, detainee transportation, emergency medical response, security coordination, and traffic management.
Third, the City should consider the compatibility of these facilities with surrounding land uses. A site near homes, schools, healthcare facilities, environmentally sensitive land, agricultural operations, or infrastructure with limited capacity may present different concerns from a site in another location. The analysis should include areas inside and outside the Urban Service Area, including Coyote Valley and other locations where water, sewer, transportation, wildfire, flooding, agricultural, or environmental issues may be especially important.
Fourth, the City should consider community trust and access to public services. Regardless of individual views about federal immigration policy, heightened enforcement activity can affect whether some residents are willing to report crimes, seek medical assistance, send children to school, cooperate with public agencies, or use other City services. These are legitimate local public-safety and service-delivery considerations.
Fifth, early planning is preferable to emergency litigation after a project is already underway. Other jurisdictions have found themselves responding to detention-facility proposals after leases were signed, property was acquired, or construction planning had begun. A short moratorium gives San Jose an opportunity to establish predictable rules before facing that situation.
During the 45-day period, I encourage the City to develop a work plan that addresses:
1. A clear and legally workable definition of detention and custodial facilities.
2. Appropriate zoning districts and site-selection standards.
3. Whether these facilities should require a conditional use permit or another form of discretionary public review.
4. Capacity limits and standards for expansion or changes in use.
5. Water, wastewater, traffic, transportation, emergency-response, and public-safety impacts.
6. Compatibility with surrounding neighborhoods, businesses, schools, healthcare facilities, agricultural land, and environmentally sensitive areas.
7. Requirements for medical services, emergency planning, fire safety, sanitation, and accessibility.
8. Opportunities for public notice and meaningful community participation.
9. Inspection, compliance, complaint, and enforcement procedures within the City's lawful authority.
10. Coordination with Santa Clara County, regional service providers, and other affected public agencies.
The staff memorandum states that a report will be prepared at least 10 days before the initial moratorium expires. That report should clearly identify the work completed, the remaining work, the proposed regulatory alternatives, the amount of additional time needed, and the legal and factual justification for any requested extension.
The report should also recognize the limits of the City's authority. San Jose should firmly exercise its legitimate land-use and proprietary powers without claiming powers that belong to the state or federal government. Maintaining that distinction will make the City's eventual regulations more credible and legally durable.
I appreciate that the proposed ordinance is temporary, limited to private property, and accompanied by specific exemptions. It does not require the Council to resolve every national dispute concerning immigration enforcement. It simply gives the City time to study a land use that its existing zoning code was not designed to address.
Given the speed with which detention proposals can develop and the potential consequences of approving a facility without adequate standards, preserving the status quo for 45 days is prudent. The temporary administrative burden is modest compared with the public, fiscal, legal, and infrastructure consequences of proceeding without an appropriate regulatory framework.
I respectfully ask the Council to provide the nine affirmative votes required to adopt Item 3.3 and to direct staff to conduct a balanced, transparent, and timely review during the moratorium.
Thank you for considering these comments and for including them in the public record for Agenda Item 3.3.
Respectfully,
Brian Darby

This matters to me, because as a volunteer with the San Jose Rapid Response Network, accompanying neighbors to DHS check-ins and to court, I have seen first-hand the damage that ICE and immigration detention activities inflicts on our families, businesses, neighbors and neighborhoods. The privately-run ICAP office on Blossom Hill Road is bad enough, as it runs roughshod over the rights of residents - a detention center would be a thousand times worse. Do we want to see ICE outrages in San Jose streets, and damage to local businesses like happened in the Twin Cities, Portland, Chicago (and are still happening in Memphis and other cities around the U.S.)? Or frequent angry protests? For a San Jose detention center would be hotly contested - make no mistake about that. DHS policies are hugely unpopular in Santa Clara County, to put it mildly.
The City should exercise its legal authority and responsibility to protect the public safety and health of all its residents.
Community trust in local government is waning at a time when many residents are experiencing heightened threats and fear. It is especially critical that we know we can trust and utilize City services in our daily lives.
We are counting on your leadership to protect the safety and wellbeing of all members of our community so that San Jose is truly a safe, prosperous, and welcoming city.

I am writing as a San Jose resident of District 3 to request your support for a complete moratorium on detention facilities on the September 15th City Council agenda: 3.3 Temporary Moratorium Related to Detention and Custodial Facility.
The privately-run ICAP office on Blossom Hill Road is bad enough, as it does not respect the rights of residents - a detention center would be a thousand times worse. Do we want to see ICE outrages in San Jose streets and damage to local businesses? (Like happened in the Twin Cities, Portland, Chicago (and are still happening in Memphis and other cities around the U.S.) Or frequent angry protests? Community trust in local government is waning at a time when many residents are experiencing heightened threats and fear. It is especially critical that we know we can trust and utilize City services in our daily lives.
The city should empower and require the police to enforce this ban, including active investigation of construction projects, property transfers, and any other similar property documents that might indicate infringement or plans to infringe. Monthly reports to the Council by the Mayor's office should be required, because some elements of local government have a rather poor track record on respecting immigrant rights without close supervision. The report should cover how local rights are being protected by our police and other officials, including documentation of actions taken and investigations completed.
Each report should be made immediately public on receipt by the Council.
We are counting on your leadership to protect the safety and well-being of all members of our community so that San Jose is truly a safe, prosperous, and welcoming city. Ideally, this would not be a temporary moratorium, but a permanent one.
Thanks,

Please support the strongest moratorium on detention facilities on the September 15th City Council agenda: 3.3 Temporary Moratorium Related to Detention and Custodial Facility This matters to me, because of the profound potential effects of a detention center within the County and this close to San Jose. Our immigrant communities are part of what makes this city a wonderful place to live. Potentially having increased ICE activity here would cause harm to our friends, family, and neighbors. It would also harm our local cultural centers and small businesses. In the 1880s my both sides of my family came to this county, we have lived in San Jose since the 60's and I was born and raised here. We all have a right to live here and be safe no matter when we arrived! Please continue to protect both our most vibrant and vulnerable neighbors.

San Jose has been my home for more than 30 years. We may not be the flashiest or coolest city, but what we are is a community woven together with a vast array of people with a diversity of economic wealth, race, ethnicity, religion, immigration status, education, housing situation, talents, hopes and dreams. This tapestry can be messy but it's what makes San Jose vibrant. It's what makes us strong.
Detention facilities create the antithesis of vibrancy. Instead, they bring fear and mistrust and division.

This matters to me, because we all know this is not the right strategy to create a fair, and equitable immigration policy in our country. I hope all of you have the political will to join with
other city council members in the Bay Area to fight
against ICE detention facilities.
The City should exercise its legal authority and responsibility to protect the public safety and health of all its residents.
This will also strengthen community trust in local government at a time when many residents are experiencing heightened threats and fear, so it is especially critical that we know we can trust and utilize City services.
We are counting on your leadership to protect the safety and wellbeing of all members of our community so that San Jose is truly a welcoming city.

I have accompanied our immigrant neighbors to their ISAP and biometrics appointments in South San Jose. The fear around being abducted is real and terrifying. I have seen our immigrant neighbors abducted at the !SAP office in South San Jose. I have seen partner's left behind when their husbands are abducted We know that the current immigration machine is not abducting the "worst of the worst." It is carrying out the racist, White supremacist agenda of the current Federal administration. We also know that Northern California is not experiencing the intensity of ICE/OHS/HSI because ICE does not have enough "processing" facilities. Any development of any offices or structures related to "holding" detainees will increase the presence of these unbridled, lawless thugs on our community. That is why it is important you support the strongest moratorium on detention facilities on the September 15th City Council agenda.

There is NO reason not to do this. This is the ethical, humane decision our city leaders must make. Rule against terror.

Please support the strongest moratorium on detention facilities on the September 15th City Council agenda: .l.l Temporary Moratorium Related to Detention and Custodial Facility This matters to me because my Japanese American parents, aunts and uncles were incarcerated during WWII by the US government using the same fascist tactics adopted by this Administration. At the time, the local governments took no steps to stop these acts ofracism. You have the power to do the right thing and stand up for all immigrants now!

Please support the strongest moratorium on detention facilities on the September 15th City Council agenda: 3.3 Temporary Moratorium Related to Detention and Custodial Facility ICE has become an unaccountable secret police force that violently dehumanizes immigrants.
In allowing this to happen, the message sent to the public is that a piece of paper determines the humanity of immigrants, and those who look like them. Make no mistake, this is the foundation for targeting communities on the basis of skin color. We must throw every wrench in the gears of this violent machine, or risk destroying the moral character of our society.
The City should exercise its legal authority and responsibility to protect the public safety and health of all its residents.

We cannot forget the words of the Mother of Exiles, who greeted the immigrants of Ellis Island:
"Give me your tired, your poor,
Your huddled masses yearning to breathe free,"

I am writing to urge your support for the strongest moratorium on detention facilities on the September 15 City Council agenda: 3.3 Temporary Moratorium Related to Detention and Custodial Facility.
This matters a great deal. As a volunteer with sec Rapid Response Network, I regularly witness members of my community shackled and forced into vans when they attend their required ICE check-ins. I have heard first-hand accounts of fellow San Joseans being denied the most basic medical care in ICE prisons. I have read in mainstream media over and over about detainees being denied due process. I have also heard firsthand and read about horrific living conditions, including sexual abuse, lack of clean water, and contaminated food, while these corporate prisons rake in enormous profits.
I returned to live in San Jose because of the welcoming feel and unique cultural diversity here. It's repeatedly acknowledged that immigrants form the backbone of our local economy. But they provide so much more than that to this city. Don't they deserve to be protected in every way possible so that they don't have to live in fear? This fear would be incalculably escalated if an ICE facility were allowed here. The federal government, in particular the OHS, has repeatedly demonstrated a willingness to ignore the rule of law. San Jose should be proactive in standing against their brazen violations of the Constitution and of basic human dignity.
The City should exercise its legal authority and responsibility to protect the public safety and health of all its residents. Doing so will strengthen community trust in local government at a time when many residents are experiencing heightened threats and fear. It is critical that we know we can trust and utilize City services.
I am counting as your leadership to protect the safety and wellbeing of all members of our community so that San Jose is truly a welcoming place.

I urge you to support the strongest moratorium on detention facilities on the September 15th City Council agenda: 3.3 Temporary Moratorium Related to Detention and Custodial Facility We need to be vigilant and protect our immigrant community from ICE. We cannot enable them to keep operating outside the law and provide them spaces where they can continue to terrorize our immigrants and US citizens alike. We have witnessed recently how they beat up and detained two young US citizens and even removed one from the country without due process.
Stories like this are available daily. Violations to our rights are abundantly popping out in the news cycle. We cannot facilitate them and be complicit.
The City has the power to exercise its legal authority and responsibility to protect the public safety and health of all its residents.
We need you to act now because the community is uncertain you will protect their interests when the Amazon data center was approved without any public council vote and the Holsclaw Rd permit was issued without proper studies and multiple irregularities. The residents arc experiencing heightened threats and fear, so it is especially critical that we know we can trust and utilize City services.
The greater community is counting on your leadership to act swiftly to protect the safety and wellbeing of all members of the community so that San Jose is truly a welcoming city.
Respectfully,
Monica Teicher
