Subject: October 6, 2026 - Public Comment on Consent Calendar Items 2.7- 2.15 [External Email. Do not open links or attachments from untrusted sources. Learn morel Dear City Clerk,
Please include this email in the public record for the October 6, 2026 City Council meeting and distribute it to the Mayor and Council as comments on Consent Calendar Items 2.7-2.15.
Dear Mayor and Councilmembers,
Thank you to city staff for preparing these materials. I appreciate the work involved in maintaining essential services, supporting community activities, and managing public resources. My principal concern is ensuring that the criminal-justice information systems addressed in Item 2.8 have clear, enforceable safeguards against unauthorized access and misuse.
Item 2.8 - Criminal-justice information access and safeguards I support providing police and other authorized personnel with accurate, timely information needed to perform their duties. Given the concerns raised in discussions about Flock cameras and access to lawenforcement information, I would appreciate an explanation of the protocols governing the City's access to the County's Criminal Justice Information Control system and Integrated Justice System.
I recognize that these are different systems from Flock. My question is whether the concerns surrounding access, sharing, and accountability are being addressed through safeguards appropriate to these databases.
Specifically:
• What written policies govern who may access these systems, what information they may retrieve, and the permitted purposes of a search?
• Must users document a legitimate work-related reason or case reference, and are searches and exports logged under individual user accounts? • Who reviews access logs, how frequently are audits conducted, and what procedures identify unusual searches or access unrelated to an employee's duties? • What restrictions govern sharing information with outside agencies, including state and federal agencies, and how is compliance monitored?
• What training, reporting procedures, and corrective actions apply when unauthorized access or misuse is suspected or confirmed?
• During the transition to the Integrated Justice System, how will the City and County preserve access controls, audit records, and data accuracy while promptly removing access that is no longer needed?
It would also be helpful to identify which responsibilities belong to the City and which belong to the County. Residents should be able to understand who is accountable for enforcing these safeguards.
I am requesting a public explanation of the governing policies and oversight process, with confidential information and sensitive security details appropriately protected. If these safeguards are already established, identifying the applicable policies and making public versions readily accessible would help build confidence. Periodic reporting of aggregate audit findings and corrective actions, where disclosure is permitted, would further support accountability.
Finally, please clarify the agreement's duration. The recommendation describes a one-year extension, while the listed dates of October 1, 2026 through June 30, 2027 cover nine months.
Item 2.7 - Regional emergency communications
I support responsibly closing an organization that staff identifies as inactive. Please clarify which agencies or arrangements now carry out the regional emergency-communications coordination that BayRICS was created to support. A final accounting of any funds returned to San Jose and associated budget adjustments would also be useful.
Item 2.9 - Communications Hill special-tax district
I support planning for the maintenance needs associated with new development. Future purchasers should receive clear information about the special tax, possible annual adjustments, and the services it supports. Please also keep accessible sidewalks, safe public routes, and maintenance of neighborhood amenities visible in the district's service priorities.
Item 2.10- Sewer and stormwater monitoring
I support investment in reliable monitoring to identify capacity problems and guide infrastructure improvements. Please provide understandable updates showing how the information collected leads to maintenance decisions, capital improvements, and better storm preparedness.
With total program costs identified as up to $3 million, including contract administration, it would be helpful to report expenditures alongside practical results. Staff's observation that an internally operated program might offer long-term savings also warrants a future comparison when the City has enough information to assess that option.
Items 2.11 and 2.12 - Free use of City Hall for private events I appreciate efforts to encourage housing dialogue, sustainability, and community partnerships.
Because these events are described as invitation-only or ticketed, please clearly identify the value of the waived facility charges and the public benefits expected in return.
Where feasible, I encourage publicly available summaries or recordings, free participation opportunities, and accommodations for people with disabilities. These measures would help extend the benefits beyond those able to attend.
Please also reconcile the two operating-cost totals in the Item 2.12 memorandum and clarify whether the repeated security charge represents two separate assignments.
Item 2.13 - Valkyries flag raising
I support recognizing women's professional sports and the community enthusiasm surrounding the team. For completeness, please provide the event's actual costs and donations received. Advance approval of future events, whenever practicable, would strengthen the public's opportunity to understand proposed expenditures.
Item 2.14 - Conference travel
The conference's focus on youth development, economic mobility, and community partnerships appears relevant to the City's work. I would welcome a brief report on useful lessons, potential local applications, and the final costs paid by the City.
Item 2.15 - Arts Commission appointment
I appreciate the applicant's willingness to serve and the City Attorney's review. I support clear disclosure and recusal procedures when matters involving affiliated organizations come before the commission, consistent with the concerns identified in that review.
Thank you for considering these comments. My aim is to support effective city services while encouraging accessible public information, responsible spending, and clear accountabilityparticularly for systems containing sensitive personal information.
Sincerely,
Brian Darby
