lley Water regarding Coyote Creek
*** This email originated from outside of Valley Water. Do not click links or open attachments unless you recognize the sender and know the content is safe. ***
Dear Valley Water Board Members, Mayor of San Jose and San Jose City Council, As concerned citizens of San Jose we have created this petition with over 230 San Jose residents' signatures (see signatories list at the bottom) with a request to add our proposed agenda item (Coyote Creek Collaboration, Flood Risk & Mitigation Plan) to the joint meeting of October 13 of the Valley Water Board, the Mayor of San Jose and San Jose City Council.
Our petition has 3 broad requests to SJNW to discuss and work toward resolution with great urgency.
Our group, Coyote Mudlarks, has invested hundreds of hours in cleaning Coyote Creek, starting at William Street and working upstream every Monday at 8:30am. After 16 cleanups since May, we are now in the vicinity of the picnic tables near the south end of William Street Park (past Large wood blockage #2 but not yet at Large wood blockage #3).
Additionally we've engaged directly with our San Jose City D3 Councilmember, San Jose City Staff, Valley Water Staff, Regional Water Quality Control Board, CDFW, USACE as well as staffs from the offices of Zoe Lofgren, Ash Kalra and Dave Cortese to show these teams the major challenges on the Coyote Creek that must be mitigated and ask for their collective help.
As citizens we may not be 100% clear on every legal nuance or detail but for a team as engaged as we are in the Coyote Creek, responsibility issues should NOT be as murky as the Coyote Creek itself. Here is the petition that was circulated and signed: https:llcoyotemud!arks,orgl Jhe Petition to City of San Jose Mayor & City council and vane:v. Water Board: Yaney Water & .C.Uy of San Jose leaders must work together on coyote creek blockages & debris Concerned neighbors in Naglee Park, Olinder, Brookwood & Roosevelt neighborhoods strongly urge the City of San Jose & Valley Water leaders to quickly agree on Coyote Creek ownership/responsibility conflicts such that large wood blockages and debris removal projects can be organized and executed.
With the projected El Nino winter having higher than normal rains, the possibility of flooding is real. No one wants a repeat of the 2017 floods.
We ask these leadership/ownership responsibility issues be addressed::
a.
b.
c. San Jose owns most of the Coyote between Tully and Montague. However, Valley Water owns the flood control & risk mitigation responsibility.
d. This complexity in ownership and responsibility leads to disagreements regarding responsibility and causes delays to implementing critical creek maintenance I flood protection work. e.
f.
g.
h. Definition of creek ownership boundaries may not be the same between VW & SJ. SJ believes ownership is defined by the center of the creek
i. (which is typical). VW believes that ownership of the creek bank stops at the water or "hinge" of j.
k.
I.
the creek. There should be a consistent definition applied to the creek. m. We request the public be informed/included in your detailed plan, including increased cooperation measures between Valley Water and the
n. City of San Jose. This communication and increased cooperation should include emergency blockage mitigations, emergency preparations and new creek maintenance agreements (with blockage & debris mitigations) moving forward.
0. The CoY.ote Creek has major risks which must be mitigated:
1. 2.
3. Imminent safetY. issue:
4. Blockages will break loose during a major atmospheric river event and cause major havoc downstream (domino effect),
5. 6.
7. 8. UnhealthY. to P-eOP-le & animals:
9. The contamination & inorganic trash trapped in the creek within and around the wood blockage is unhealthy & unsafe to San Jose residents and wildlife as well as San Francisco Bay.
10. 11.
12. 13. Potential violations to Federal Clean Water Act:
14. Environmental degradation causing Federal Clean Water Act concerns.
15. The section of Coyote Creek from William Street to 1-280 contains at least 9 major wood blockages with debris. Additionally, the wood blockages in Coyote Creek from Tully Road to Montague Expressway should be considered in their entirety due to the above mentioned domino effect.
We urge the City of San Jose and Valley Water to work together to improve and preserve the health of the Coyote Creek riparian ecosystem. This creek is habitat to threatened species and species of concern; debris and pollution threaten their continued survival. The invasive shot hole borer is now thriving in trees along the creek. Invasive plant species are pushing out native plants, for instance ivy is choking out native plants and trees. 40 and more years ago residents played and fished in the creek - it was an integral part of residents' lives. This habitat deserves better as the creek must become healthy enough for Steelhead and Chinook to spawn and clean enough for children to play in the Coyote again.
Signed,
Coyote Mudlarks,
Mark Schroeder
