CITY OF SAN JUAN BAUTISTA

CITY COUNCIL STAFF REPORT
DATE: NOVEMBER 4, 2025
DEPARTMENT: CITY MANAGER
FROM: ASHLEY COLLICK, CITY MANAGER
TITLE: AUTHORIZING THE CITY MANAGER (OR DESIGNEE) TO

EXECUTE RIGHT-OF-WAY CERTIFICATIONS AND RELATED

DOCUMENTS FOR CALTRANS PROJECTS
RECOMMENDATION:

Approve a Resolution authorizing the City Manager or designee to execute all of the right-of-way certifications, agreements, and related documents required by the California Department of Transportation (Caltrans) for projects administered by or in cooperation with the City of San Juan Bautista.

BACKGROUND:

The City of San Juan Bautista periodically undertakes or participates in transportation projects requiring coordination with the California Department of Transportation (Caltrans).

As part of Caltrans’ Local Assistance process, cities must provide formal right-of-way certification and supporting documentation before project approval or release of construction funding.

Historically, the City has adopted project-specific resolutions, such as Resolution No. 2025-47, approving the purchase offer and temporary construction easement for the SR 156 / The Alameda Right Turn Lane Project.

To improve efficiency and meet Caltrans’ documentation standards, Caltrans has requested a standing authorization—similar to City of Santa Barbara Resolution No. 08-047—designating a city official with blanket authority to execute right-of-way certifications and related forms.

This action would allow the City Manager or designee to sign necessary right-of-way certifications, environmental commitments, and cooperative agreements, subject to legal review by the City Attorney.

FISCAL IMPACT
There is no direct fiscal impact associated with this action.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN BAUTISTA AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE RIGHT-OFWAY CERTIFICATIONS AND RELATED DOCUMENTS REQUIRED BY THE

CALIFORNIA DEPARTMENT OF TRANSPORTATION (CALTRANS) FOR

PROJECTS ADMINISTERED BY OR IN COOPERATION WITH THE CITY WHEREAS, the City of San Juan Bautista periodically undertakes or participates in projects involving the California Department of Transportation (Caltrans), the Federal Highway Administration (FHWA), and other transportation agencies; and WHEREAS, such projects require the City to certify right-of-way clearance, property acquisition, environmental compliance, and related matters prior to construction or funding authorization; and
WHEREAS, Caltrans has requested that the City adopt a resolution granting ongoing authority to a designated City official to execute right-of-way certifications and other related documents necessary for the completion of transportation projects; and WHEREAS, the City Council finds that providing such authorization promotes efficiency, ensures compliance with State and Federal requirements, and facilitates the timely delivery of public works projects.

1. The City Manager or designee is hereby authorized and directed, subject to review and approval as to form by the City Attorney, to execute on behalf of the City all necessary commitments, certifications, and related documents required by Caltrans, FHWA, or other public agencies having oversight or regulatory authority for City transportation projects, including but not limited to:
