SAN JUAN CAPISTRANO CITY COUNCIL
EXECUTIVE SESSION MEETING
Mayor Pro Tem Troy Bourne called the June 4, 2024, Special Executive Session meeting of the City Council to order at 3:31p.m., in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS IN ATTENDANCE: Mayor Sergio Farias (arrived shortly after commencement), Mayor Pro Tem Troy Bourne and Council Members Howard Hart, John Taylor, and John Campbell (arrived shortly after commencement).
COUNCIL MEMBERS ABSENT: None.
ORAL COMMUNICATIONS/CORRESPONDENCE/PUBLIC COMMENT ON EXECUTIVE SESSION ITEMS: None.
EXECUTIVE SESSION (610.85)
An Executive Session was held for the following purposes, as authorized by statute:
a. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council conferred with legal counsel pertaining to existing litigation in the matter of Preserve Our Farm SJC v. City of San Juan Capistrano et al., OC Superior Court Case No. 30-2024-01399667-CU-MC-NJC.
b. Pursuant to Government Code Section 54956.8, the City Council met with its Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger, City Attorney) concerning the price and terms of payment concerning certain real property located at the northeast corner of La Novia Avenue and San Juan Creek Road, APNs 666-013-03, 04, and 06 and 666-042-10 and 11. Negotiating party:
The Ecology Center.
c. Pursuant to Government Code Section 54956.9(d) (4), the City Council conferred with Legal Counsel to discuss initiation of litigation (1 item). d. Pursuant to Government Code Section 54956.9 (a), (d)(2), the City Council conferred with Legal Counsel to discuss anticipated litigation – significant exposure to litigation (2 items).
ANNOUNCEMENT OF EXECUTIVE SESSION ACTIONS: None.
ADJOURNMENT:
There being no further business, Mayor Pro Tem Troy Bourne adjourned the meeting to Tuesday, June 4, 2024, at 5:00 p.m. for a Public Business Session, in the City Council Chamber at the Community Center – 25925 Camino Del Avion.
