SAN JUAN CAPISTRANO CITY COUNCIL
EXECUTIVE SESSION MEETING
Mayor Farias called the September 17, 2024, Special Executive Session meeting of the City Council to order at 3:31 p.m., in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS IN ATTENDANCE: Mayor Sergio Farias, Mayor Pro Tem Troy Bourne (arrived shortly after commencement) and Council Members Howard Hart and John Taylor.
COUNCIL MEMBERS ABSENT: Council Member John Campbell.
ORAL COMMUNICATIONS/CORRESPONDENCE/PUBLIC COMMENT ON EXECUTIVE SESSION ITEMS: None.
EXECUTIVE SESSION (610.85)
An Executive Session was held for the following purposes, as authorized by statute:
a. Pursuant to Government Code Section 54956.8, the City Council met with its Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger, City Attorney) concerning the price and terms of payment concerning certain real property located at 31796 El Camino Real, 31872 El Camino Real, 31882 El Camino Real. Negotiating Party: San Juan Capistrano Performing Arts Center, a California nonprofit corporation.
b. Pursuant to Government Code Section 54956.9 (a), (d)(2), the City Council conferred with Legal Counsel to discuss anticipated litigation – significant exposure to litigation (3 items).
c. Pursuant to Government Code Section 54956.8, the City Council met with its Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger, City Attorney) concerning the price and terms of payment concerning certain real property located at 31283 through 31297 Don Juan Avenue (the terminus of Don Juan Avenue), APNs 649-271-69 through 74. Negotiating Party: Gene Broussard, AMG & Associates, LLC.
ANNOUNCEMENT OF EXECUTIVE SESSION ACTIONS: Mayor Farias recused himself from one item under executive session item B. Council Member Taylor recused himself from executive session item A because his son rents from him and works for the applicant; and one item under executive session item B.
ADJOURNMENT:
There being no further business, Mayor Farias adjourned the meeting to Tuesday, September 17, 2024, at 5:00 p.m. for a Public Business Session, in the City Council Chamber at the Community Center – 25925 Camino Del Avion.
