AMENDMENT NO. 2 TO CONSULTING SERVICES AGREEMENT BETWEEN
THE CITY OF SAN LEANDRO AND
MACKAY METERS, INC.
FOR
SINGLE SPACE PARKING METERS
This Amendment No. 2 (“Amendment”) is made by and between the City of San Leandro (“City”) and MacKay Meters, Inc. (“Consultant”) (together sometimes referred to as the “Parties”) as of as December 4, 2021, and amends that certain Consulting Services Agreement (“Agreement”) dated December 4, 2018, between the Parties.
WHEREAS, City and Consultant have executed the Agreement, pursuant to which Consultant has provided certain consulting services to City with regard to parking meter management, and WHEREAS, the Parties desire to amend the Agreement to extend the agreement until December 4, 2023 and increase the total compensation by $104,792 for a total of $217,792.
NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby acknowledged, the Parties hereby agree to amend the Agreement as follows:
1. Section 1.1 of the Agreement entitled “Term of Services” is hereby amended to extend the term from December 4, 2021, to December 4, 2023; and
2. Section 2 of the Agreement entitled “Compensation” is hereby amended to pay Consultant a sum not to exceed $217,792; and
3. Exhibit A of the Agreement entitled “Scope of Services” is hereby amended to include the purchase of seventy (70) 4G LTE replacement radio drawers to be installed by City staff no later than July 1, 2022, as specified in Attachment A.
4. Exhibit B of the Agreement entitled “Compensation Schedule & Reimbursable Expenses” is hereby amended to include the following parts:

This Amendment may be executed in multiple counterparts, each of which shall be an original and all of which together shall constitute one agreement.

As a result of the sunsetting of 3G cellular services by wireless carrier partners, certain MacKay metering products will not be able to communicate with your meter management system (SentinelTM MMS) or process credit card transactions by no later then July 2022.
The phase out of the 3G cellular network was made at the discretion of the respective cellular carriers, and lies beyond the control of MacKay. To minimize disruption, MacKay is offering an easy and efficient upgrade path to 4G cellular technology.
The MacKay SINGLE SPACE product line has been designed modularly and built for an easy on street retrofit.
This on street upgrade will take less then 30 seconds to complete as the radio module requiring upgrade is a true ‘plug and play’ device. Simply:
Remove power from device
Remove radio drawer
Install new radio drawer
Power device back up
Push reset
The cost of a 4G LTE replacement radio drawer (Part # - 15MM0520101) is $240.00. However, a $40.00 credit for every 3G radio drawer that is replaced and returned to MacKay is available.
Delivery of LTE radio drawers is anticipated to begin by end of February 2022. MacKay is currently accepting orders on a on a ‘first come, first serve’ basis. Please note, delivery time is up to 6- weeks from time of order due to the current stressed global supply chain. To avoid delays, we recommend you order your LTE radio drawers through your local MacKay representative today.
IMPORTANT NOTICE: You must meet the following criteria before your LTE radio drawers will be shipped to you:
1.) Have provided a Purchase Order for the LTE radio drawers
2.) The Purchase Order has been reviewed and approved by MacKay
3.) Your account with MacKay must be current (ie. less then 31 days old) at time of shipping your LTE radio drawers.
