IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO
RESOLUTION NO. 2022-
RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO
APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A LEGAL
SERVICES AGREEMENT WITH CASTILLO, MORIARTY, TRAN & ROBINSON THROUGH JUNE 30, 2024 FOR A TOTAL NOT TO EXCEED AMOUNT OF $500,000 WHEREAS, the City, in accordance with its purchasing provisions, has identified Castillo, Moriarty, Tran & Robinson to provide legal representation associated with tort liability claims and litigation; and
WHEREAS, the City wishes to transfer cases from previous legal representation with Bertrand, Fox, Elliot, Osman & Wenzel (BFEOW), and Allen, Glaessner, Hazelwood & Werth (AGHW) to Castillo, Moriarty, Tran & Robinson (CMTR) to continue supporting existing cases and future litigation; and
WHEREAS, the attorneys at Castillo, Moriarty, Tran & Robinson have provided the City Council and the City’s administration with excellent service representing the City of San Leandro in tort liability and litigation; and
WHEREAS, Risk Management has sufficient funds in Fiscal Year 2022-2023 account 689-19-004-5110 for legal services; and
WHEREAS, Castillo, Moriarty, Tran & Robinson has agreed to the terms of the contract pending Council approval; and
WHEREAS the City Council is familiar with the contents of the agreement; and WHEREAS, the City Manager recommends approval of said agreement.
NOW, THEREFORE, the City of San Leandro City Council does RESOLVE as follows:
That the agreement is approved and execution by the City Manager is hereby authorized.
