RESOLUTION NO. 2024-XXX
RESOLUTION INITIALLY ACCEPTING SUBDIVISION IMPROVEMENT WORK FOR TRACT 8519 AT 903 MANOR BOULEVARD; ASSESSOR’S PARCEL NO. 080H-1541-036, OWNER: DR HORTON BAY, INC., A
DELAWARE CORPORATION
WHEREAS, pursuant to an agreement between the City and D.R. Horton Bay Inc., A Delaware Corporation dated September 7, 2021, and approved by Resolution No. 2021-124, the subdivision work for Tract 8519 has been completed; and
WHEREAS, said work has been completed in accordance with the plans and specifications and therefore to the satisfaction of the Public Works Director, and she therefore recommends that said work be accepted.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
1. That the work hereinbefore described is hereby accepted; and
2. That the bonds heretofore given for performance and payment of said conditions are hereby discharged and exonerated from further liability; and
3. That upon completion of the one-year Maintenance Period established pursuant to said contract, and to the satisfaction of the Public Works Director, the City Manager is hereby authorized to release the bond heretofore given for maintenance of the work hereinbefore described.
