IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO
RESOLUTION NO. 2025-XXX
RESOLUTION TO AUTHORIZE THE CITY MANAGER TO EXECUTE A NON-PROFESSIONAL SERVICES
AGREEMENT WITH MCNABB CONSTRUCTION FOR DEMOLITION OF THE HALCYON PARK PLAYGROUND FOR $49,140.00 AND TO NEGOTIATE AND APPROVE CUMULATIVE CHANGE ORDERS UP TO 10% OR $4,914.00, FOR A TOTAL NOT-TO-EXCEED AMOUNT OF $54,054.00 WHEREAS, Halcyon Park Playground was destroyed by arson on October 6, 2024; and WHEREAS, The damaged structure requires complete removal and replacement; and WHEREAS, Chapter 1-6 of the San Leandro Municipal Code does not require informal or competitive bidding for contracts under $60,000; and
WHEREAS, The City has an existing contract with McNabb Construction for FEMA-funded rehabilitation of Marina Park playground surfacing and efficiency supports, which including an additional project under the contract; and
WHEREAS, The City Council is familiar with the contents of the agreement and finds its terms acceptable; and
WHEREAS, The City Manager recommends approval of said agreement.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
1. That the agreement, substantially in the form presented, is approved and the City Manager is authorized to execute the agreement with McNabb Construction for the demolition of the playground at Halcyon Park for an amount not-to-exceed $54,054.00; and
2. That the City Manager or her designee is authorized to negotiate and approve cumulative change orders up to a maximum of 10% of the original contract amount, or $4,914.00 for a total not-to-exceed $54,054.00.
3. That the City Manager is authorized to take all actions and execute all documents necessary to affect the purpose and intent of this Resolution.
