IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO
RESOLUTION NO. 2025-XXX
RESOLUTION TO APPROVE AMENDMENT TO TITLE 6, CHAPTER 4 OF THE SAN LEANDRO
ADMINISTRATIVE CODE AMENDING FEES AND CHARGES FOR WASTE WATER DISCHARGE FOR FISCAL YEARS 2025-2026 THROUGH 2029-2030
WHEREAS, the Water Pollution Control Enterprise Fund has rate setting objectives to adequately fund sewer utility operations, maintenance, capital replacement expenditures and debt service obligations, while keeping rates as competitive as possible and maintaining a prudent level of reserves; and
WHEREAS, the City conducted a Wastewater Rates Study to ensure equitable allocation among customer classifications and project the fiscal sustainability of the wastewater utility; and
WHEREAS, this Wastewater Rate Study, concluded that wastewater utility rates need to be increased to adequately fund operations, maintenance, capital replacement expenditures and debt service operations; and
WHEREAS, all property owners within the City’s sewer service area were sent notifications of proposed rates on March 17th in accordance with Proposition 218; AND WHEREAS, proposed adjustments to the Master Fee schedule is presented to the City Council; and
WHEREAS, the City Council is familiar with the contents thereof.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
1. That following public notice and public hearing as required by law, Title 6, Chapter 4, Section 6.4.110 of the San Leandro Administrative Code (“Fee Schedule”) is hereby amended by the attachment hereto, which is made a part hereof; and
2. That the Fee Schedule section entitled “Wastewater Discharge Fees” is made a part of this resolution and is enacted thereby; and
3. That the provisions of the amended Fee Schedule identified herein as the attachment hereto shall take effect on July 1, 2025, and shall be automatically effective without further legislative action each subsequent July 1st until July 1, 2029.
