IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO
RESOLUTION NO. 2025-XXX
ADOPT A RESOLUTION TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE AMENDMENT NO. 1 TO AN EXISTING CONSULTING SERVICES AGREEMENT WITH MNS ENGINEERS, INC. THAT INCREASES THE AMOUNT OF COMPENSATION BY $106,140 FOR A TOTAL NOT-TO-EXCEED AMOUNT OF $513,337; AND TO AUTHORIZE ADDITIONAL AGREEMENT AMENDMENTS UP TO A MAXIMUM OF 15% ($77,000) OF THE
NEW TOTAL CONTRACT FOR PROFESSIONAL DESIGN SERVICES IN SUPPORT OF THE CARY-HAAS PEDESTRIAN BRIDGE REPLACEMENT, PROJECT NO. 2024.1010 .
WHEREAS, an agreement dated November 5, 2024, exists between the City of San Leandro and MNS Engineers, Inc. in support of the Cary-Haas Pedestrian Bridge Replacement, Project no. 2024.1010; and
WHEREAS, a contract amendment is required to compensate additional consulting services for design revisions, construction administration, and field observation; and WHEREAS, MNS Engineers, Inc. has agreed to the terms of the amendment pending Council approval; and
WHEREAS, the City Council is familiar with the contents thereof; and
WHEREAS, the City Manager recommends approval of said agreement.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
That said Amendment No. 1 substantially in the form presented is hereby approved and execution by the City Manager is hereby authorized; and That the City Manager is authorized to make non-substantial revisions to said agreement, subject to approval as to form by the City Attorney; and That the City Manager or her designee is authorized to negotiate and approve additional contract amendment up to 15%, or $77,000 of the new total contract amount; and That an original executed agreement shall be attached to and made a part of this resolution.
