RESOLUTION NO. 2025-XXX
RESOLUTION TO AUTHORIZE A LIMITED WAIVER OF THE ATTORNEY-CLIENT PRIVILEGE FOR PURPOSES OF RELEASING THE DRAFT 2024 REVENUE MEASURE TRACKING SURVEY RESULTS IN
RESPONSE TO A PUBLIC RECORDS ACT REQUEST
WHEREAS, the City received a Public Records Act request seeking the Revenue Measure Tracking Survey Results; and
WHEREAS, the requested document constitutes attorney-client privileged communication under Evidence Code § 950 et seq.; and
WHEREAS, the privilege belongs to the City Council and may be waived only upon its express authorization; and
WHEREAS, the City Council desires to waive the privilege solely for this specifically identified document and not for any other communication.
NOW THEREFORE, the City of San Leandro City Council does hereby RESOLVE as follows:
A limited waiver of attorney-client privilege for the document titled Revenue Measure Tracking Survey Results, dated June 2024, is hereby authorized; and The City Council directs the City Attorney and City Clerk to release the document to any requesting parties; and
The City Council states expressly that the waiver applies only to this document and shall not be construed as a waiver of privilege regarding any other communication.
