5a. 25-543 Adopt a Resolution to Approve and Authorize the City Manager to Execute Amendment No. 2 to the Consulting Services Agreement with the East Bay SPCA for Animal Welfare Services to Extend the term to June 30, 2027; and Increase the Contract Amount by $579,500 for a Total Amount Not to Exceed $1,517,000 and to Authorize Additional Cumulative Agreement Amendments Up to 10% ($151,700)

A motion was made by Councilmember Aguilar, Jr., seconded by Councilmember Simon, that this Staff Report be Approved. The motion CARRIED by the following vote:

5b. 25-593 Discussion and possible action to schedule disciplinary hearings for Councilmember Aguilar and Councilmember Simon
A motion was made by Vice Mayor Bowen, seconded by Councilmember Viveros-Walton, to agendize a disciplinary hearing for Councilmember Aguilar and Councilmember Simon on January 20, 2025, with all disciplinary options available, up to and including censure. The motion CARRIED by the following vote:
Ayes: 4 - Boldt, Bowen, Viveros-Walton, González
Noes: 3 - Aguilar, Azevedo, Simon
A motion was made by Councilmember Viveros-Walton, seconded by Councilmember Boldt, to schedule an agenda item on January 5, 2025, for discussion and possible action regarding wavier of attorney-client privilege in relation to the October 31, 2025 report. The motion CARRIED by the following vote:
