IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO
RESOLUTION NO. 2026-XXX
RESOLUTION TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE AMENDMENT NO. 2 TO THE CONSULTING SERVICES AGREEMENT WITH LARRY WALKER ASSOCIATES, INC. FOR
MUNICIPAL REGIONAL STORMWATER PERMIT (MRP) COMPLIANCE PLANNING SUPPORT FOR A NEW TOTAL NOT-TO-EXCEED AMOUNT OF $380,300
WHEREAS, as a result of the 1972 Clean Water Act that established the National Pollutant Discharge Elimination System (NPDES), the San Francisco Regional Water Quality Control Board (RWQCB) issues the Municipal Regional Stormwater Permit (MRP), which specifies and mandates stormwater pollution prevention activities; and
WHEREAS, the MRP requires 70+ municipalities in the Bay Area, including the City of San Leandro, to place conditions on development projects to incorporate site design measures, source controls, treatment measures, and on larger projects, flow duration controls (FDCs), and requires the City to inspect, maintain, and install trash control programs and infrastructure; and WHEREAS, on September 1, 2024, the City entered into an agreement with LWA for MRP compliance planning support, and as of FY 2025, the City has spent the original contract’s not-to-exceed amount of $49,000; and
WHEREAS, on August 25, 2025, the City executed Amendment No. 1 with LWA for MRP compliance planning support, and as of FY 2026, the City will have used the not-to-exceed amount of $219,500; and
WHEREAS, additional work is required to complete stormwater program development and compliance reporting in FY 2027, which will cost an additional $160,800.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
That Amendment No. 2 to the Consulting Services Agreement is approved and the City Manager is hereby authorized to execute the amendment with Larry Walker Associates, Inc. for MRP compliance planning support in an amount not to exceed $380,300.
