RESOLUTION NO. 2026-XXX
RESOLUTION TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A CONSULTING SERVICES AGREEMENT WITH ALTA PLANNING + DESIGN, INC. FOR THE BAY FAIR DEVELOPMENT PLAN AND SPECIFIC PLAN UPDATE IN AN AMOUNT NOT TO EXCEED $1,345,585 (MTC PDA GRANT-FUNDED)
WHEREAS, the Bay Fair Transit-Oriented Development (TOD) Specific Plan was adopted in 2018 and amended in 2020, and together with the implementing B-TOD Zoning adopted in 2021 promotes the long-term sustainability and vibrancy of the Bay Fair area as a walkable, transit-oriented, mixed-use district; and
WHEREAS, in 2023 the Metropolitan Transportation Commission (MTC) awarded the City a grant in the amount of $1,800,000 to prepare a Development Plan and related updates to the Bay Fair TOD Specific Plan, General Plan, and Zoning Code; and
WHEREAS, on September 27, 2023 the City issued a Request for Proposals (“RFP”) for professional services to prepare the Bay Fair Transit-Oriented Development Sub-Area 1 Development Plan and Specific Plan Update and distributed the RFP to qualified consultant firms and held a preproposal conference on October 11, 2023; and WHEREAS, eight proposals were received on the required submittal deadline of October 30, 2023; and
WHEREAS, in accordance with the California Government Code and other applicable laws, Community Development Department and Public Works staff carefully reviewed the qualifications and proposals; and
WHEREAS, a CSA for the Bay Fair Development Plan and Specific Plan Update was previously authorized and initiated with a different consulting team; and WHEREAS, however, the City now intends to retain Alta Planning + Design, Inc. as prime consultant to prepare the Bay Fair Development Plan and Specific Plan Update; and WHEREAS, to avoid delay and maintain project momentum, staff proposes engaging Alta Planning + Design, Inc. to complete the Bay Fair Development Plan and Specific Plan Update pursuant to San Leandro Municipal Code Sec. 1-6-315, the City Council finds that a waiver of the competitive selection process is justified; and
WHEREAS, the Consulting Services Agreement is fully funded by the MTC Priority Development Area (PDA) planning grant in an amount not to exceed $1,345,585; and WHEREAS, the Consulting Services Agreement is presented to this City Council; and DRAFT

WHEREAS, the City Manager recommends approval of said Agreement.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
1. That the Consulting Services Agreement with Alta Planning + Design, Inc. for the Bay Fair Development Plan and Specific Plan Update, in an amount not to exceed $1,345,585, is hereby approved; and
2. The City Manager (or her designee) is hereby authorized to finalize the scope of work for the preparation of the Bay Fair TOD Development Plan, Specific Plan Amendments, and related environmental document; and
3. That the City Manager, or her designee, is authorized to take all actions and execute all documents necessary to effect the purpose and intent of this Resolution for the consulting services agreement referred to herein.
