RESOLUTION TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A CONSULTING SERVICES AGREEMENT WITH LEE & RO, INC. IN THE AMOUNT OF $143,902 FOR BIDDING AND
CONSTRUCTION SUPPORT SERVICES IN SUPPORT OF DAVIS STREET MANHOLE REPLACEMENT, PROJECT NO. 2018.6000; TO AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND APPROVE INDIVIDUAL CONTRACT AMENDMENTS UP TO 10% (OR $14,390) OF THE ORIGINAL CONTRACT AMOUNT; AND TO AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND APPROVE CONTRACT AMENDMENTS UP TO A CUMULATIVE VALUE NOT TO EXCEED 25% (OR $35,976) OF THE ORIGINAL
CONTRACT AMOUNT
WHEREAS, on April 20, 2020 by Resolution No. 2020-035, the City of San Leandro executed a design services contract with Lee & Ro Inc. (Lee & Ro) for the Secondary Effluent Line Replacement and Davis Street Manhole Replacement Project; and
WHEREAS, design of Phase 2 of the Project, Davis Street Manhole Replacement, Project No. 2018.6000, is nearly complete such that to advance the Project to construction it has become necessary to execute an additional bidding and construction consulting services agreement with Lee & Ro; and WHEREAS, the subject project is categorically exempt from the California Environmental Quality Act; and
WHEREAS, contract amendments to clarify the work or respond to unusual existing conditions are a normal aspect of public contracting and construction; and WHEREAS, in order to expedite the delivery of public projects on schedule and on budget, provide that subcontractors and workers are paid in a timely fashion, avoid as much as possible costly delay claims, and ensure that the City completes projects and products that are to the City's highest standards, the City Council finds that providing authorization on this project to the City Manager or her designee to negotiate and approve contract amendments to this contract is in the best interest of public health, safety and welfare.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
That said City Council hereby awards a Consultant Services Agreement for said services to Lee & Ro, Inc. in the amount of $143,902; and
That the City Manager or her designee is authorized to negotiate and approve individual contract amendments up to 10%, or $14,390, of the original contract amount; and That the City Manager or her designee is authorized to negotiate and approve cumulative contract amendments up to 25%, or $35,976 of the original contract amount; and That the City Manager is authorized to take all actions and execute all documents necessary to effect the purpose and intent of this Resolution.
