IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO
RESOLUTION NO. 2026-XXX
RESOLUTION TO AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN INCREASE IN THE CUMULATIVE CHANGE ORDER LIMIT FROM 25% TO 35% (FROM $291,338 TO $407,874) FOR SANITARY SEWER POINT REPAIRS 2024 - 25 AND FLORESTA BLVD SANITARY SEWER REPLACEMENT, PROJECT NO. 2024.0120
WHEREAS, the City of San Leandro did on March 9, 2026, award a construction contract to Westland Contractors, Inc. for $1,165,352 and authorized the City Manager to approve a cumulative change order limit of 25% (or $291,338) by Resolution No. 2026-024 for Sanitary Sewer Point Repairs 2024 - 25 and Floresta Blvd Sanitary Sewer Replacement, Project No. 2024.0120; and WHEREAS, an increase in bid quantities is required to address unforeseen field conditions; and
WHEREAS, in order to expedite the delivery of public projects on schedule and on budget, provide that subcontractors and workers are paid in a timely fashion, avoid as much as possible costly delay claims, and ensure that the City completes projects and products that are to the City’s highest standards, the City Council finds that providing authorization to negotiate and approve change orders is in the best interest of public health, safety and welfare; and WHEREAS, the total cost of the additional change order work is $407,874, which exceeds the authorized change order limit of 25% (or $291,338) of the original contract amount.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
That the City Manager or her designee is authorized to negotiate and approve cumulative change orders up to a maximum of $407,874, which is 35% of the original contract amount; and That the City Manager is authorized to take all actions and execute all documents necessary to effect the purpose and intent of this Resolution.
