RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS AUTHORIZING THE CITY MANAGER TO NEGOTIATE, FINALIZE AND EXECUTE RIGHT OF WAY CONTRACTS FOR THE ACQUISITION OF EASEMENTS AND RIGHT OF ENTRY AGREEMENTS FOR THE SAN MARCOS BOULEVARD AT DISCOVERY STREET INTERSECTION PROJECT (CIP #86002) Whereas, City Council previously adopted Resolution 2021-8902, which approved construction documents, and authorized the City Manager to advertise for bid, award, finalize, and execute the construction contract documents for the San Marcos Boulevard at Discovery Street Intersection Project (CIP #86002, "Project”); and WHEREAS, the Right of Way Contracts identify the necessary easements and right of entry agreements for the Project and provide fair compensation for the acquisition of such rights; and WHEREAS, said real property interests are necessary for Project function, construction, and long term maintenance; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Marcos that the City Manager is authorized to negotiate, finalize, and execute Right of Way Contracts for the acquisition of easements and right of entry agreements for the San Marcos Boulevard and Discovery Street Intersection Project (CIP #86002); PASSED, APPROVED, and ADOPTED by the City Council of the City of San Marcos, California, this 10th day of May 2022, by the following vote:
