RESOLUTION NO. 2022-9062
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, CALIFORNIA, APPROVING AND AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE FAIR POLITICAL PRACTICES COMMISSION TO OBTAIN CERTIFICATION OF AN ELECTRONIC FILING SYSTEM FOR PROCESSING STATEMENTS OF ECONOMIC INTERESTS (FORM 700) AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE APPLICATION AND ANY RELATED DOCUMENTS WHEREAS, the City of San Marcos (“City”) currently administers the filing of all campaign disclosure documents and statements as well as the Statements of Economic Interests (Form 700) required by the Political Reform Act and/or by its own regulations for local designated filers by way of hard copy submissions to the City Clerk; and WHEREAS, to facilitate the efficient submission and administration of such documents, and to provide greater transparency and availability of such materials to the public, the City desires to transition to an online electronic filing (“e-filing”) system for campaign disclosure and reporting documents as well as for the Fair Political Practices Commission (“FPPC”) Form 700 Statement of Economic Interests (“Form 700”) for all local filers; and WHEREAS, the City Manager has determined that NetFile is uniquely qualified to provide the ability to receive filing campaign disclosure data electronically and post it online for public viewing and, as a result, it is in the City’s best interest to waive the requirement for solicitation of multiple proposals, pursuant to SMMC section 2.30.080(b), and to utilize NetFile as a sole-source vendor; and WHEREAS, although the City presently has the authority to require e-filing of statements, reports, or other documents under the Political Reform Act pursuant to Government Code section 84615, the inclusion of an e-filing component for the Form 700 requires certification of the electronic filing system by the FPPC to the effect that all requirements are included in the program; and WHEREAS, NetFile has assisted with the preparation of an application to the FPPC in the form attached hereto as Exhibit A and incorporated herein by reference, which, if and when approved, will allow future amendments to the San Marcos Municipal Code relating to e-filing of Form 700; and WHEREAS, upon certification of a program by the FPPC and the implementation of a local e-filing system, all local filers will be able to e-file Form 700 through the City’s system, and campaign disclosure documents can also be e-filed.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Marcos does hereby approve the submission of the application attached as Exhibit A to the FPPC, to obtain certification of an electronic filing system for processing Statements of Economic Interest and that, upon the issuance of such certification, Council anticipates that staff will return to it with proposed amendments to the San Marcos Municipal Code to provide for e-filing of statements, reports, or other documents under the Political Reform Act, and Form 700 documents, and hereby authorizes the City Manager to execute the application and any documents related thereto.
