A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS ENTERING INTO A COMMUNITY FACILITIES FUNDING AGREEMENT WITH URBAN VILLAGES SAN MARCOS, LLC AND NORTH CITY UNIVERSITY ONE, LLC FOR THE CONSTRUCTION OF THE PEDESTRIAN BRIDGE OVER BARHAM ROAD FROM NORTH CITY TO CALIFORNIA STATE UNIVERSITY SAN MARCOS
WHEREAS, the University District Specific Plan, as amended, provides for the construction of a variety of new public facilities in conjunction with the development of the specific plan area; and WHEREAS, one of the public facility components is a pedestrian bridge linking the specific plan area directly to California State University San Marcos (CSUSM) ; and WHEREAS, in 2019, Urban Villages San Marcos (UVSM) constructed the pedestrian bridge connecting the specific plan area to CSUSM; and
WHEREAS, the purpose of the pedestrian bridge is to create a grade separated pedestrian crossing of Barham Road from the specific plan area to CSUSM; and WHEREAS, as a condition of development improvement for projects within the specific plan area, those parcels of land that are part of a development project are required to annex into the City’s Congestion Management Community Facilities District (CFD 2011‐01); and WHEREAS, CFD 2011‐11 contemplates a number of traffic congestion mitigation strategies including public facilities that can reduce traffic signal cycle times due to reduced pedestrian crossings; and
WHEREAS, the pedestrian bridge connecting the specific plan area to CSUSM provides that grade separated pedestrian connection that can help mitigate the number of pedestrians crossing Barham Road at street level, thus allowing that intersection to function more efficiently for both vehicular and pedestrian traffic; and
WHEREAS, in recognition of the benefit to the specific plan area, CSUSM and the public in general, the City views the use of CFD 2011‐11 funds to reimburse UVSM for the costs of the bridge with the limitation that only CFD 2011‐11 funds generated by development projects within the specific plan area are eligible for said reimbursement; and WHEREAS, UVSM has provided the City with a detailed accounting of the design, project management and construction costs of the pedestrian bridge to the satisfaction of the City and an agreement has been prepared to formalize the reimbursement of CFD 2011‐11 funds for the project
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Marcos does hereby enter into a Community Facilities District Funding Agreement for this purpose, said Agreement attached herewith.
