FACTS:
On March 23, 2022, an Abatement Warrant for property at 839 Cassou Road, San Marcos, CA 92069 Assessor’s Parcel #: 1822302000 was approved by the Court. Notice was provided to the property owner’s address as recorded by the County of San Diego Assessor's Office. Based on competitive bids from three (3) vendors, the City chose the lowest bid that met the qualifications to provide services. Abatement services were provided on April 07, 2022.
FINDINGS:
After considering all relevant testimony and evidence, the Hearing Officer has determined that the Prima Facie case is established as pertains to Forced Abatement Costs.
Appellant’s testimony in support of his defense that he did not receive prior notice from the City of required abatement, the Abatement Warrant, and the forced abatement services to be provided is not substantiated by the evidence presented and is not a valid defense. The City served the property owner by USPS obtaining the property owner’s mailing address on record from the County of San Diego Assessor's Office.
The Property Owner is required to pay in full all costs that are due to the City of San Marcos for the above referenced abatement.
The costs as presented by the City are UPHELD.
