Dear Jill Malad:

RE: Written Comments Regarding the City of San Marco’s Exempt Surplus Land Disposition Documentation for the Property at APNs 221-100-14, 33, 56 and 64.

Thank you for notifying the Department of Housing and Community Development (HCD) of the City of San Marcos’s declaration of property located at APNs 221-100-14, 33, 56 and 64 as exempt surplus land. HCD reviewed the documentation you provided. HCD concludes that APNs 221-100-14, 33, 56 and 64 are grandfathered under Government Code Section 54234 because the property is subject to an exclusive negotiating agreement (ENA) that was entered into prior to September 30, 2019, and the disposition will be completed no later than December 31, 2022. As such, the property is subject to the Surplus Land Act as it existed on December 31, 2019.

Once the City of San Marcos has completed the disposition, please provide documentation for HCD’s records.

Please email [email protected]
if you have any questions.

Sincerely,

Public Lands Manager
