RESOLUTION NO. 2022-9098
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS SELECTING CLEAN ENERGY ALLIANCE DEFAULT POWER SUPPLY PRODUCT FOR ALL ELECTRIC SERVICE ACCOUNTS WITHIN THE CITY’S JURISDICTION.

WHEREAS, Community Choice Aggregation is a mechanism that allows local governments to purchase and supply electrical power to customers within their jurisdictions as an alternative to the service provided by an investor-owned utility; and WHEREAS, on November 9, 2021, the City Council approved and adopted Resolution No. 2021-8950 and Ordinance No. 2021-1508 to enter into a Joint Powers Agreement with the cities of Del Mar, Carlsbad and Solana Beach (founding members) to join Clean Energy Alliance (CEA) and to implement a Community Choice Aggregation (CCA) Program in the City; and WHEREAS, Section 6.5 of the Clean Energy Alliance Joint Powers Agreement states that the CEA’s power supply base product will be greater than or equal to 50% qualified renewable resources; and WHEREAS, Section 6.5 of the Clean Energy Alliance Joint Powers Agreement also states that the Clean Energy Alliance Board of Directors shall establish product options with higher renewable and/or GHG-free content that each member City may select; and WHEREAS, on March 4, 2021, the Clean Energy Alliance Board of Directors adopted Clean Energy Alliance Resolution No. 2021-017, establishing Clean Energy Alliance rates and power supply product offerings to include:

Clean Impact: Minimum 50% Renewable Energy Product,
Clean Impact Plus: 50% Renewable and 75% Carbon-Free Energy Product, and Green Impact: 100% Renewable Energy Product; and
WHEREAS, on December 13, 2022, the City Council adopted Resolution No. 2022-9098 establishing “Clean Impact Plus” as the default power supply product for all customer accounts (municipal, commercial, industrial and residential) within the City’s jurisdictions.

NOW, THEREFORE, the City Council does hereby find and ordain as follows:

The foregoing recitals are true and correct, and are hereby incorporated by reference into this Resolution.

The City Council as a member of the Clean Energy Alliance selects Clean Impact Plus as the default power supply product offering for all customer accounts including municipal, commercial, industrial and residential within the City of San Marcos jurisdiction.

That the City Manager or his designee shall provide a copy of this Resolution to Clean Energy Alliance.

All requirements of CEQA have been met in that the selection of default power supply product is not a project as defined in Section 15378 of the CEQA Guidelines because there is no potential for it to result in a physical change in the environment, either directly or indirectly. Even if the selection of default power supply product were to be considered a project subject to CEQA, it would be exempt from CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines because it can be seen with certainty that there is no possibility that the proposed project would have a significant effect on the environment.

PASSED, APPROVED, AND ADOPTED by the City Council of the City of San Marcos, California, at a regular meeting thereof, held on this 13th day of December 2022, by the following roll call vote:
