ii. Facility Application Number, or Permit to Operate Number; or iii. Facility Notice of Violation/Notice to Comply Number.

4. If the search for records finds the records voluminous, you will be notified of the approximate number of pages and/or length of time it will take to process your request.

5. If the records you requested have been marked confidential by the source of the record, you will be notified and process.

6. If your request is to review records, rather than receive copies, the District will notify you once the records are gathered, and arrangements will be made for your review.

In addition, when records are requested in electronic format, the requestor shall bear the cost of producing a copy of the record, including the cost to construct the record and the cost of programming and computer services necessary to produce a copy of the record when either of the following applies: (1) the District would be required to produce a copy of an electronic record and the record is one that is produced only at otherwise regularly scheduled intervals, or (2) the request would require data compilation, extraction, or programming to produce the record. [Gov. Code Sec. 6253.9(b)] The District will provide an invoice for charges due along with the copied records. These charges are due and payable upon receipt of the invoice and the copied records. ADDITIONAL COMMENTS:

Case origniated on June 8, 1988 following observation of contamination . (several holes in tank and stainedjodiferous soils; water observed in excavation) during the removal of two underground storage tanks (2000 gallon 1000 gallon gasoline) under HMMD permit. A total of 980 cubic yards of conatminated soil was excavated, stockpiled, and treated in an above ground bio-treatment cell. Treated soil was sampled and results (<10 mg/kg TPH; <det. limits for BEX; T: 0.11 and 0.17 were acceptable for use as backfill material (approval 2/91). Final confirmation samples for excavation were obtained May 1991. A total of five monitoring wells were installed (two wells, PM-2 and PM-3 were ordered by HMMD to be destroyed due to improper construction). Water samples from well PM-5 revealed elevated TPH and BTEX values. Groundwater was intermittently pumped from well PM-5 from approx. 8/90 to 6/91. Purge water and pumped water from PM-5 (approx. 248 gallons) were approved by Vallecitos Water District for discharge to the sanitary sewer system. The wells were monitored after pumping ceased on a quarterly annual basis from December 1991 to September 1992 and laboratory results were less than detection limits· (<0.5 for BTEX compounds.

Site is currently a vacant dirt lot.

Please re-evaluate your determination and provide DTSC, within 60 days of the receipt of this letter, either of the following:

1. A Summary Progress Report as required by California Health and Safety Code, (Health & Safety Code) Section 25244.19(b)(1 0); or

2. Supporting data and/or other information to justify your exemption claim.

Your response should be sent to:
