RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS RATIFYING AND APPROVING THE ACCEPTANCE OF CREDIT CARD, DEBIT CARD, OR ELECTRONIC FUNDS TRANSFER FOR PAYMENT OF CITY SERVICES, FEES, CHARGES, TAXES DUE, OR OTHER DEBTS OWED TO THE CITY, AND AUTHORIZING A TRANSACTION PROCESSING FEE FOR PAYMENT OF CITY SERVICES FEES, CHARGES, TAXES DUE, OR OTHER DEBTS OWED TO THE CITY USING CREDIT CARD, DEBIT CARD, OR ELECTRONIC FUNDS TRANSFER.
WHEREAS, California Government Code § 6159(b) authorizes the city to accept a credit card, debit card, or electronic funds transfer in payment for city services, fees, charges, taxes due, or other debts owed to the city; and WHEREAS, pursuant to Section 203 of the City Charter, the City has the power to engage in any enterprise deemed necessary to produce revenues for the general fund or any other fund established by the City Council to promote a public purpose; it is in the best interest of the City, its citizens, and the business community to accept credit card, debit card, or electronic funds transfer to pay for city services, fees, charges, taxes due, or other debts owed to the city; and WHEREAS, it is also in the best interest of the City to accept credit card, debit card, or electronic funds transfer in payment for city services, fees, charges, taxes due, or other debts owed to the city, and to pass through such costs as are incurred and associated with using this payment mechanism; and WHEREAS, Government Code § 6159(h)(1) allows the imposition of fees for the use of credit card, debit card, or electronic funds transfer, not to exceed the costs incurred by the city in providing for payment by credit or debit card or electronic funds transfer; and WHEREAS, there is a cost to the City in accepting payments by credit card, debit card, or electronic funds transfer; and WHEREAS, the City desires to authorize a transaction fee, not to exceed fees charged by the processor, for use of credit card, debit card, or electronic funds transfer.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Marcos does hereby ratify and approve the acceptance of credit card, debit card, or electronic funds transfer in payment for City services, fees, charges, taxes due, or other debts owed to the City, and further that the City Council authorizes a transaction fee, not to exceed such fees as are charged by the processor for the provision of payment by credit card, debit card, or electronic funds transfer.
