RESOLUTION NO. 2023- 186
A RESOLUTION OF THE CITY COUNCIL OF THE CHARTERED CITY OF
VISTA, CALIFORNIA, OPPOSING THE FIXED ENERGY CHARGES
AUTHORIZED IN ASSEMBLY BILL 205 ENERGY ( 2021- 2022)
The City Council of the City of Vista does resolve as follows:
1. Findings. The City Council hereby finds and declares the following:
A. Assembly Bill ( AB) 205 Energy ( 2021- 2022) was signed into law by California Governor Newsom on June 30, 2022.
B. This bill contains a variety of energy measures. The City objects to one specific provision of AB 205. Specifically, AB 205 repeals the existing $ 10 fixed charge cap for residential investor - owned utility customers and authorizes the California Public Utilities Commission ( CPUC) to use fixed charges for any rate schedule for residential customers.
C. The bill requires the fixed charge to be established on an income -graduated basis with no fewer than three income thresholds. In other words, electric utility customers would be paying a fixed charge based on income and not electricity usage.
D. This fixed charge provision of AB 205 was inserted into the bill without debate or discussion. The fixed charge provision of AB 205 was not justified by any facts or empirical evidence before its passage by the State.
2. Action.
A. The City Council opposes the fixed energy charges authorized in AB 205 and urges the CPUC to not implement these fixed charges.
B. The City Council further resolves that the City Manager, or designee, continue to advocate for the repeal of AB 205' s income - based fixed charges.
3. Adoption. PASSED AND ADOPTED at a meeting of the City Council of the City of Vista held on October 24, 2023, by the following vote:
