RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS APPROVING CONSTRUCTION DOCUMENTS, AUTHORIZING ADVERTISEMENT FOR BID, AND DELEGATING AUTHORITY TO THE CITY MANAGER TO AWARD, FINALIZE, AND EXECUTE THE CONSTRUCTION CONTRACT DOCUMENTS FOR THE CLARIFIER REPLACEMENT PROJECT (CIP #FC014), AND FURTHER DELEGATING AUTHORITY TO THE CITY MANAGER TO ENTER INTO A REIMBURSEMENT AGREEMENT OR ACCEPT FUNDS, AS APPLICABLE, FROM SAN MARCOS UNIFIED SCHOOL DISTRICT FOR COST-SHARING THE PROJECT Whereas, construction documents for the Clarifier Replacement Project (CIP #FC014, hereinafter "Project”), have been completed; and WHEREAS, the Project improvements will replace three of the existing clarifiers at the Public Works Yard which are reaching the end of their useful life; and also apply anti-corrosion lining on the new and existing clarifiers along with associated drainage improvements, and WHEARAS, the City of San Marcos and San Marcos Unified School District both utilize the clarifiers on an equal basis, and WHEREAS, the City desires to complete the construction of the Project in an expeditious manner; and WHEREAS, delegating to and authorizing the City Manager to approve construction documents, award, finalize, and execute the applicable contract documents will facilitate the expeditious and orderly construction of the Project; and WHEREAS, further delegating to and authorizing the City Manager to sign a reimbursement agreement or equivalent with San Marcos Unified School District to share in the cost of the Project is beneficial to the financial health of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Marcos as follows:
The foregoing recitals are true and correct;
The construction documents for the Clarifier Replacement Project (CIP #FC014), consisting of plans, specifications, and project special provisions, have been reviewed are hereby approved; The advertisement for bid the Clarifier Replacement Project (CIP #FC014) is approved; The City Manager is delegated the authority to award the Project, and to execute the contract with the lowest responsive and responsible bidder for the Clarifier Replacement Project (CIP #FC014), provided the bid is within the approved Project budget; The City Manager is delegated the authority to enter into a reimbursement agreement or similar agreement with San Marcos Unified School District to share in the cost of the Project.
