RESOLUTION NO. 2024-XXXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS AUTHORIZING THE EXECUTION OF THE SAN DIEGO REGIONAL STORMWATER COPERMITTEE FIFTH AMENDED MEMORANDUM OF UNDERSTANDING WHEREAS, the Memorandum of Understanding (MOU) entered into by the San Diego Regional Copermittees establishes the shared program responsibilities of each party with respect to compliance with the San Diego Regional Water Quality Control Board Order No. R9-2013-0001, as amended by Order Nos. R9-2015-0001 and R9-2015-0100 (Permit); and, WHEREAS, the Permit requires that the Copermittees cooperate in the implementation of various Water Quality Improvement Plans and watershed management strategies; and, WHEREAS, the proposed amended MOU establishes the fiscal responsibilities shared by all Copermittees and provides the conditions for work plan generation and shared cost budgets to implement the programs and activities required in the Permit; and, WHEREAS, staff has reviewed the proposed amended MOU and determined that it establishes cost sharing in a reasonable and equitable manner with reasonable basis for cost-sharing activities.
NOW, THEREFORE, BE IT RESOLVED that the City Manager, is hereby delegated signature authority to execute the amended MOU on behalf of the City of San Marcos; and BE IT FURTHER RESOLVED that the amended MOU is recognized to be effective for five (5) years from the date that the last party to sign executes the MOU.
