RESOLUTION NO. 2024-XXXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN MARCOS ADOPTING AN UPDATED CITY COUNCIL
MEETING POLICY AND PROCEDURES
WHEREAS, the City Council (Council) of the City of San Marcos is (City) committed to the orderly, reasonable, effective, and timely conduct of municipal business at its City Council meetings; and
WHEREAS, the existing City Council policy regarding its meetings and procedures is entitled “Council Meetings Policies and Procedures,” and was adopted pursuant to Resolution 2013-7748; and
WHEREAS, subsequent to the adoption of Resolution 20 13-7748, Ralph M.
Brown Act provisions have been revised to clarify certain aspects of meetings of legislative bodies including, but not limited to, enforcement of rules of decorum; and
WHEREAS, the City Council desires to update its policies and procedures concerning its meetings to include updated provisions of the Ralph M. Brown Act, and to incorporate provisions relating to internal City practices relating to the conduct of City Council meetings including, but not limited to, speaker presentations and time.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Marcos does hereby adopt that certain City Council Meeting Policy and Procedures, attached hereto as Exhibit “A” and incorporated herein by this reference as though fully set forth at this point, to immediate effect.
BE IT FURTHER RESOLVED, that i f any section, sentence, clause or phrase of this Resolution and/or Exhibit “A” is determined to be invalid, illegal or unconstitutional by a decision or order of any court or agency of competent jurisdiction, then such decision or order will not affect the validity and enforceability of the remaining portions of this Resolution and/or Exhibit “A ,” as applicable. The City Council declares that it would have passed and adopted the Resolution and/or Exhibit “A,” and each sectio n, sentence, clause or phrase thereof, regardless of the fact that any one or more Resolution No. 2024-XXXX
sections, subsections, sentences, clauses, or phrases be declared invalid or unconstitutional.
PASSED, APPROVED, AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS at a regular meeting held on the 25th day of June, 2024, by the following roll call vote:
