RESOLUTION NO. 2024-XXXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS APPROVING AND ADOPTING THE ACTIVE TRANSPORTATION PLAN City of San Marcos
WHEREAS, the City of San Marcos desires to forward its vision for active transportation citywide via an Active Transportation Plan (ATP); and WHEREAS, the ATP will holistically address pedestrian and bicycle travel citywide, consistent with General Plan policies M-3.1 and M-3.9 emphasizing the importance of integrated transportation planning; and WHEREAS, the ATP includes a Safe Route to School element to improve accessibility and connectivity within a half-mile radius of SMUSD schools; and WHEREAS, public outreach to the community included the opportunity for public comment via public workshops and events, an online comment website, coordination with surrounding jurisdictions, and collaboration with the San Marcos School District; and WHEREAS, the Development Services Department did study said request, and recommends approval of said request; and WHEREAS, on May 15, 2024, the San Marcos Climate Action Plan Working Group received a presentation on the proposed ATP; and WHEREAS, on June 5, 2024, the San Marcos Traffic Commission held a duly-noticed public hearing in the manner prescribed by law and filed the proposed ATP for reference; and WHEREAS, on June 17, 2024, the San Marcos Planning Commission held a duly-noticed public hearing in the manner prescribed by law to consider said request and filed the ATP for reference; and WHEREAS, on July 23, 2024, the City Council held a duly-noticed public hearing in the manner prescribed by law to consider said request; and WHEREAS, the adoption of the ATP is not a project as defined in Section 15378 of the CEQA Guidelines because there is no potential for it to result in a physical change in the environment, either directly or indirectly; and even if adoption were to be considered a project subject to CEQA, it would be exempt from CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines because it can be seen with certainty that there is no possibility that the proposed resolutions would have a significant effect on the environment.
NOW, THEREFORE, the City Council does hereby resolve as follows:
The foregoing recitals are true and correct, and they are hereby incorporated by reference into this Resolution.
The City Council hereby approves and adopts the Active Transportation Plan, as shown on the attached Exhibit A, incorporated by reference and made a part of this Resolution as though fully set forth herein.
The City Council’s decision is based on the following findings and determinations:
The proposed Active Transportation Plan is consistent with the Goals and Objectives in the General Plan and provide for a balanced mobility framework for all modes of travel.
The proposed Active Transportation Plan is deemed to be in the public interest, in that its adoption will continue to achieve the goals and policies set by the City for transportation planning and will encourage projects and programs to support active transportation connectivity citywide.
The proposed Active Transportation Plan will not be detrimental to the public health, safety, and welfare, in that the ATP is consistent with the policies and goals of the General Plan Mobility Element and will promote the welfare of people working, living, and traveling through the city by encouraging a citywide network of pedestrian and bicycle facilities.
All requirements of CEQA have been met, in that the adoption of the Active Transportation Plan meets a categorical exemption under the common sense rule, in that the proposed changes are policy-level changes that will not result in physical improvements.
The adoption of the Active Transportation Plan is exempt from environmental review pursuant to CEQA Section 15061(b)(3).
