RESOLUTION NO. 2024-XXXX

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS APPROVING A GENERAL PLAN AMENDMENT TO AMEND THE MOBILITY ELEMENT GPA24-0001
City of San Marcos
WHEREAS, Government Code sections 65350 et seq. require each planning agency and legislative body of each city to adopt a comprehensive, long-term general plan for the physical development of the city; and WHEREAS, Section 65358 of the Government Code specifies the requirements for the amendment of all or part of a General Plan; and WHEREAS, the City of San Marcos desires to modify its General Plan for the purposes of updating performance measures, modifying truck route management, and addressing active transportation planning; and WHEREAS, the Development Services Department did study said request, and recommends approval of said request; and WHEREAS, on June 17, 2024, the San Marcos Planning Commission held a duly-noticed public hearing in the manner prescribed by law to consider said request and approved Resolution PC24-5112 recommending to City Council the approval of GPA24-0001; and WHEREAS, on July 23, 2024, the City Council held a duly-noticed public hearing in the manner prescribed by law to consider said request; and WHEREAS, the City Council did review and consider the previously-adopted Final Environmental Impact Report (FEIR11-44) (SCH No. 2011071028) and determined that no new environmental information or documentation was presented revealing any new unidentified environmental impacts that had not been previously mitigated and the proposed project is within the scope of the impacts identified in FEIR11-44; and WHEREAS, the City Council did review and consider a Categorical Exemption EX24-009 for said request pursuant to the California Environmental Quality Act (CEQA).

NOW, THEREFORE, the City Council does hereby resolve as follows:

The foregoing recitals are true and correct, and they are hereby incorporated by reference into this Resolution.

The City Council hereby approves this General Plan Amendment, as shown on the attached Exhibit A, incorporated by reference and made a part of this Resolution as though fully set forth herein.

The City Council’s decision is based on the following findings and determinations:

The proposed General Plan Amendment is consistent with the Goals and Objectives in the General Plan, in that the proposed changes continue to provide consistency with the approved land uses and provide for a balanced mobility framework for all modes of travel within the city.

The proposed General Plan Amendment is deemed to be in the public interest, in that its adoption will continue to achieve the goals and policies set by the City for transportation planning.

The proposed General Plan Amendment will not be detrimental to the public health, safety, and welfare, in that the policy changes are consistent with those that already exist within the General Plan Mobility Element. The proposed changes will ensure that the planned mobility element features will be properly executed, consistent with the existing land use plan.

All requirements of CEQA have been met, in that the proposed General Plan Amendment qualifies for a categorical exemption under the common sense rule, in that the proposed changes are policy-level changes that will not result in physical improvements. Additionally, the proposed changes have been reviewed and found to be consistent with the previously certified FEIR 11-44.

This General Plan Amendment is Categorically Exempt (EX24-009) from environmental review pursuant to CEQA Section 15061(b)(3). Additionally, this General Plan Amendment is within the scope of the previously certified Final Environmental Impact Report Environmental Impact Report (FEIR11-44) (SCH No. 2011071028).
