TERMINATION OF
DECLARATION OF COVENANT FOR STREET IMPROVEMENTS
This Termination of Declaration of Covenant for Street Improvements (“Termination”) is issued this ____ day of __________ 20__ by the City of San Marcos (“City”) with respect to the following:
1. On or about March 27, 1975, the City was made the beneficiary of a Declaration of Covenant for Street Improvements recorded with the San Diego County Recorder’s Office as Document Number 75-070059 (“Covenant”).
2. The Covenant related to the deferment of street improvements for West La Cienega Road located within that certain real property identified as APN 182-210-19-00 located at 157 West La Cienega Road (“the Real Property”). Reference is made to the Covenant, the terms and provisions of which are incorporated herein by reference. As in the Covenant, the La Cienega Road street improvement area is referenced herein as “the Street Improvement Area.”
3. On September 10, 2024, the City Council of the City of San Marcos approved Resolution No. 2024-9344 (“Resolution”), for the summary vacation and abandonment of public right-of-way for a portion of West La Cienega Road, reserving therefrom utility rights. The Resolution also approved the termination of the Covenant.
4. By this Termination, City terminates the Covenant, and neither the Real Property nor the owner of the Real Property are bound by the same from and after September 10, 2024, the effective date of the Resolution.
