RESOLUTION NO. 2024-XXXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS DELEGATING TO AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE, FINALIZE, AND EXECUTE CONTRACT AMENDMENTS FOR THE ANNUAL SURFACE SEAL PROJECT (CIP# ST001) Whereas, the Annual Surface Seal Project (Project) is a construction project to repair and maintain pavement throughout the City of San Marcos; and Whereas, the City Council approved the construction documents and delegated authority to the City Manager to award, finalize, and execute the construction contract documents for the Project on June 27, 2023; and WHEREAS, the City extended the scope of the Project to include the additional adjacent roadway that was in need of repair; and Whereas, the Project budget had sufficient funds appropriated to incorporate the additional roadway repair; and Whereas, the construction phase of work for the Project is nearing completion; and WHEREAS, the City’s Purchasing Ordinance permits the City Manager to authorize change orders up to $250,000 for a contract; and WHEREAS, the City desires to streamline the budget management of the Project to facilitate and align with close-out of construction activities; and, WHEREAS, additional change orders will be necessary to compensate the Contractor for additional changes discovered during construction.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
The City Council delegates to and authorizes the City Manager to negotiate, finalize, and execute amendments to the construction Contract within the approved budget appropriated to the Project.
