RESOLUTION NO. 2024 -XXXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, CALIFORNIA, APPROVING ADDENDUM #1 TO THE CITY MANAGER’S EMPLOYMENT AGREEMENT WHEREAS, the City entered into an employment agree with City Manager Michelle Bender on September 13, 2023 (Employment Agreement) provides for an initial term of four (4) years commencing on September 15, 2023, and expiring on September 14, 2027; and WHEREAS, the City Council evaluated the performance of the City Manager and desires to extend the base term of her Employment Agreement for two (2) additional years to September 14, 2029; and WHEREAS, the City Council agrees to provide Bender with a merit increase of 6.00%, retroactive to the pay period commencing on September 13, 2024; and WHEREAS, the City Council agrees to provide Bender an annual deferred contribution of $30,000.00 per year; and WHEREAS, the City Council agrees to provide Bender a one-time additional 80 hours of executive leave, in addition to the agreed upon 80 hours, totaling 160 hours of executive leave; and WHEREAS, the City Council agrees to provide the City Manager group a 1.00% base salary contribution to the City’s Retiree Health Savings (RHS) Plan.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN MARCOS, CALIFORNIA, RESOLVES AS FOLLOWS:
SECTION 1. The above-described recitals are true and correct.
SECTION 2. The City Council hereby approves the Addendum to the City Manager Employment Agreement.
SECTION 3. The Resolution shall take effect immediately upon its adoption.
