RESOLUTION NO. 2025-XXXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS DELEGATING TO AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE, FINALIZE, AND EXECUTE CONTRACT AMENDMENTS FOR THE RANCHO SANTA FE PAVEMENT RESTORATION PROJECT (CIP# ST014) Whereas, the Rancho Santa Fe Pavement Restoration Project (Project) is a construction project to repair and maintain pavement and other improvements within the City of San Marcos; and Whereas, the City Council approved the construction documents and delegated authority to the City Manager to award, finalize, and execute the construction contract documents for the Project on April 23, 2024; and WHEREAS, due to conditions following contract award the City will revise the paving method for the southbound direction of the Project to avoid delays in repairing the road; and Whereas, the Project budget contained an appropriation of funds sufficient to accommodate the additional roadway repair costs; and Whereas, the construction phase of work for the Project is nearing completion; and WHEREAS, the purchasing provisions of Chapter 2.30 of the San Marcos Municipal Code permit the City Manager to authorize change orders for a contract up to ten percent of the original contract amount; and WHEREAS, the City desires to streamline the budget management of the Project to facilitate and align with completion and close-out of construction activities; and, WHEREAS, additional change orders which will exceed the City Manager’s authority under the San Marcos Municipal Code will be necessary to compensate the Contractor for additional changes during construction.
NOW, THEREFORE, BE IT RESOLVED as follows:
The City Council hereby delegates to and authorizes the City Manager to negotiate, finalize, and execute amendments to the construction Contract in excess of ten percent limit contained in the San Marcos Municipal Code section 2.30.030(c), provided that no combination of such amendments of the Contract or other allocated expenses will exceed the approved and appropriated Project budget.
