Subject: Appeal for Waiver of Fine
Dear City council:

I am writing to formally appeal the fine issued under Section 3.16.100 of the San Marcos Municipal Code. The fine, which pertains to the late payment of transient tax, is one I take full responsibility for, but I believe the circumstances surrounding the delay warrant your understanding and leniency.

The fine was issued because I was unable to submit the payment on time. Although I completely forgot to make the payment by the due date, I was in the city office the very next morning with a check in hand, only to be informed that it was too late to avoid the penalty. I understand that forgetting is not an excuse in itself, but I would like to share the reasons for this oversight.

Over the past two years, I have been under significant stress and responsibilities. I am the primary caregiver for my 8-year-old daughter, managing all school drop-offs, pick- ups, meals, and daily needs. Additionally, I am the sole caretaker for my 88-year-old mother, who requires constant attention and assistance. My obligations extend beyond family care; I run a hotel and manage several other businesses in San Marcos, which adds an immense workload and pressure.

On the night before the due date, I was occupied with final preparations for Halloween to ensure my daughter could participate in trick-or-treating. Her costume had torn, and I spent the night sewing and making sure everything was in place for her to enjoy the event. Amidst these duties, the payment deadline unfortunately slipped my mind.

Compounding these challenges, my wife of 30 years recently filed for divorce, seeking a path separate from our marriage. This has placed an emotional strain on my family, particularly on my daughter, and has added a layer of stress that affects my focus and daily responsibilities.

I have been an active and consistent business owner in San Marcos since the early 2000s, always striving to meet my obligations on time. I respectfully ask that you take my circumstances into consideration and grant a waiver or reduction of the fine. The past couple of years have been exceptionally trying, and I am hopeful that you will find compassion in understanding my situation.

Thank you for taking the time to review my appeal. I deeply appreciate your consideration and understanding. Please let me know if there is any further information you require.

Yours sincerely,
Joe Lin
