RESOLUTION NO. 2025-XXXX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS AUTHORIZING THE CITY MANAGER TO NEGOTIATE, FINALIZE, AND EXECUTE EMERGENCY CONTRACT FOR CITY FACILITY HVAC SYSTEMS, LOCATED AT 180 WEST MISSION ROAD, AND AUTHORIZING THE APPROPRIATIONS OF EMERGENCY RESERVE FUNDS INTO THE OPERATINANAL AND CAPITAL IMPROVEMENT PROGRAM AS NESSESSARY WHEREAS, the City facility, located at 180 West Mission Road, is a critical city facility necessary for the ongoing operations of the City; and WHEREAS, the Heating, Ventilation, and Air Conditioning systems at City facility, located at 180 West Mission Road, has progressively deteriorated over time due to age, operational strain and its codependency on the Senior Activity Center; and, WHEREAS, the HVAC system has suffered a failure that cannot be serviced in a manner that would allow it to become fully operable; and, WHEREAS, temporary measures have been deployed to mitigate the current failure, but their continued use cannot extend for a prolonged period of time; and, WHEREAS, pursuant to Section 2.30.110 of the San Marcos Municipal code emergency contracts may be let where there is a designated emergency issue; and, WHEREAS, the City desires to appropriate funds for the repair of the HVAC system; and, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Marcos as follows:
The City finds and determines that the failure of the HVAC system at Fire Station one in an emergency necessitating immediate procurement and appropriations to effectuate the repair.
The City Manger is hereby authorized to negotiate, finalize and execute emergency contract(s) as necessary to effectuate the needed repairs.
The City’s Catastrophic/Emergency Reserve Funds are hereby appropriated for a not-to-exceed amount of $3,000,000.
The City Manager is hereby authorized and delegated authority to budget appropriated funds in appropriate operational and capital improvement program funds as may be needed for the repair.
