CALL TO ORDER: Mayor Jones called the City Council Meeting to order at 3:00 p.m.

PRESENT: COUNCILMEMBERS: JONES, LEBLANG, MUSGROVE, NUÑEZ, SANNELLA ABSENT: COUNCILMEMBERS: NONE
ORAL COMMUNICATIONS
There were no requests to speak.
APPEAL OF TRANSIENT OCCUPANCY TAX DELINQUENCY PENALTY (DAYS INN) Public Comment Concerning Appeal in Question – There was no public comment.
Staff Presentation – Finance Director Donna Apar provided the staff report.
Council Questions Included: timeline clarification, interest payments on amount, payment period, history of late payments, and online payment system.
Appellant Presentation – Joe Lin provided the appellant presentation.
Council Questions Included: history of any late payments.
Staff Rebuttal – Finance Director Donna Apar provided the rebuttal statement.
Appellant Rebuttal – Joe Lin provided the appellant rebuttal Staff Closing Statement – Finance Director Donna Apar provided the closing statement.
Appellant Closing Statement – Joe Lin provided the appellant closing statement.
Council Questions Included: TOT tax payment amounts, users and rates, process of how the money is held until payment, municipal code mandates, communication between city and operator, determination of TOT amount and provisions for refunds.
MOTION BY MAYOR JONES, SECONDED BY DEPUTY MAYOR SANNELLA TO DENY THE TRANSIENT OCCUPANCY TAX DELINQUENCY PENALTY APPEAL BY THE OPERATOR OF THE DAYS INN.
