RESOLUTION NO. 2025-XXXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, CALIFORNIA, AMENDING THE INFRACTION AND MISDEMEANOR BAIL SCHEDULE WHEREAS, the City of San Marcos (“City”) has established in Title 1, Chapter 1.12 of the San Marcos Municipal Code (SMMC) and Charter that any person violating any provision or failing to comply with any requirement of the Municipal Code shall be guilty of an infraction or misdemeanor as delineated in Title 1, Chapter 1.12; and WHEREAS, SMMC section 1.12 060 authorizes the City Council to approve fine amounts imposed for violations of the SMMC; and WHEREAS, SMMC Chapter 5.55 regulates the licensing of Tobacco Retailers in the City; and WHEREAS, the City Council desires to set the fine amount for violations of SMMC Chapter 5.55 Tobacco Retail License at $1,000 per violation; and WHEREAS, staff recommends the City of San Marcos 2024 Misdemeanor and Infraction Bail Schedule attached herein as Attachment 1 be amended to include the $1,000 fine per violation of the SMMC 5.55 Tobacco Retail License as delineated in Attachment 2; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Marcos makes the following determinations:
The above recitals are true and correct.
The City of San Marcos Infraction and Misdemeanor Bail Schedule is amended to include the bail amount of $1000 for violations of SMMC Chapter 5.55 as delineated in Attachment 2.
Hereafter, any person convicted of a violation of SMMC Chapter 5.55 shall be fined in accordance with the amount set forth in the attached City of San Marcos Infraction and Misdemeanor Bail Schedule.
The City of San Marcos Infraction and Misdemeanor Bail Schedule may be amended from time to time by Resolution of the City Council.
PASSED, APPROVED AND ADOPTED by the City Council of the City of San Marcos, State of California at its regular meeting held on this 28th day of October, 2025, having duly considered the fine and bail amounts of violations of SMMC Chapter 5.55, by the following roll call vote:
