Executive Summary
The Public Works Department oversees maintenance and improvements for the City’s public facilities, including aquatic centers. Approval of the proposed Resolution would award a contract for the Woodland Pool Replaster Project, which includes necessary upgrades and improvements to ensure safety, efficiency, and long -term functionality of the Woodland Park pool.
Discussion
Woodland Park Pool is a key recreational amenity for the community, and maintaining the pool in safe, reliable conditions is essential for public use, programming, and seasonal operations. Completing the replaster work will restore the pool surface, improve safety and water quality, and help ensure the facility is ready for the planned opening date.
The existing pool interior finish has reached the end of its useful service life and requires replastering to support continued, reliable operations. The scope of work includes, but not limited to:
· Pool surface preparation and demolition as needed
· Repasting and application of new interior finish
· Tile and coping replacement as needed
· Associated start up, water balance, and commissioning to return to service This project supports the City Council’sstrategic themes of planning for the future and dynamic, responsive service delivery by reinvesting in the Woodland Park Pool to keep the facility safe, functional, and ready to serve the community for years to come.

N/A
Executive Summary
The 2026 Surface Seal Project (Project) will resurface approximately 21 centerline miles of roadways throughout the city. Staff recommends the City Council approve construction documents, authorize advertisement for bid, and delegate authority to the City Manager to award and execute the contract documents necessary for construction of the project. Construction documents are on file with Development Services.
Discussion
The Project is part of the City’sAnnual Surface Seal Program CIP# ST011 and will perform preventative maintenance activities in the form of slurry sealing and microsurfacing approximately 21 centerline miles of roadways throughout the City. The project will also include traffic signal improvements at the signalized intersections within the project limits.
As with other pavement resurfacing projects, staff typically review and refine the striping and pavement markings to improve safety for all modes of travel. Typical striping and pavement marking refinements include adding new bike lanes or enhancing existing bike lanes, where sufficient space exists. This Project will add or enhance bike lanes on Borden Rd., Melrose Dr., and Montiel Rd., ensuring continuation of enhanced bike lanes within and surrounding the project limits.
Staff recommends that the City Council approve the construction documents, authorize the City Manager to award the construction contract to the lowest responsive and responsible bidder, and to negotiate, finalize, and City of San Marcos Printed on 2/20/2026Page 1 of 2

execute the construction contract to expedite construction activities.
Environmental Review
The Project is exempt from California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301, Existing Facilities Class 1(c). This includes the proposed project scope to do minor alterations to existing public facilities including streets, sidewalks, gutters, bicycle lanes, and similar facilities involving negligible or no expansion.
Fiscal Impact
The Project (CIP# ST011) is budgeted and approved in the Fiscal Year 2025-2026 Capital Improvement Program Budget and is funded with Gas Tax, TransNet LSI, and RMRA funds. The construction cost of the Project is anticipated to be $4,000,000, which is within the allotted budget.

Executive Summary
The City of San Marcos owns and operates the Civic Center complex, which is made up of 3 buildings and a parking structure. The City Hall building is part of the City’s revenue-generating Enterprise Real Estate Portfolio, which contributes non-tax revenue towards the City’s General Fund. As part of upkeep and maintenance duties, waterproofing work is required for the parking structure, which had been included in the FY 2025-26 Adopted Annual Operations & Capital Improvement Program Budget. The project will ensure compliance with lease terms as a landlord, maintain marketability of the spaces, and also ensure safety of the structure for visitors to City Hall and the Community Center who park in the structure.
On behalf of the City, the City’sreal property management consultant initiated a request for proposal (RFP) for the waterproofing work at the parking structure at the Civic Center Complex on November 21, 2025, which resulted in no bids. In accordance with the San Marcos Municipal Code procurement requirements, the City’s property management group then solicited informal bids from other companies and received two proposals.
Staff reviewed the proposals, and seeks City Council approval to award the contract to Structural Preservation Systems for waterproofing of the Civic Center parking structure, and to authorize the City Manager to negotiate, finalize, and execute contract documents.

Discussion
The City operates a real estate portfolio as part of the fulfillment of Section 203 of the San Marcos Charter, which emphasizes enterprise activities designed to produce non-tax revenue sources. The City leases out portions of floor 1 and 2, and the entirety of floor 3 and 4 of the City Hall building, the proceeds from which contributes revenue towards the City’sGeneral Fund each year. As a commercial real estate operator, the City is required to maintain the buildings and common spaces patroned by tenants and customers for safety, aesthetic, and legal purposes.
A request for proposal (RFP) for re-roofing was issued on November 21, 2025 for waterproofing of various sections of the parking structure at the Civic Center complex (building 4). The request for proposal was advertised by IDS Real Estate, as the City’sreal property management consultant, on behalf of the City.
Subsequently, no bids were received as a result of the request for proposal. Per City Municipal Code 2.30.060, informal bids were then solicited directly from three firms, resulting in two proposals. Of the two proposals, Structural Preservation Systems was deemed to be a qualified firm for the work, and the selection of Structural Preservation Systems resulted in a significant cost savings compared to the competing proposal.
The proposal outlined the work needed, which includes waterproofing of large sections of the parking structure which are currently experiencing issues with moisture, including electrical rooms, facades, and other areas of the parking structure. The re-paving work will fulfill requirements of the City as the landlord to maintain a parking structure that is safe, well-maintained, and free of any potential hazards.
The FY 2025-26 budget for the project is sufficient to cover the proposed contract with Structural Preservation Systems, as well as potential change orders, additional support work, labor compliance, and other project- related items. Staff reviewed the proposal for the project and seeks City Council approval to award the waterproofing contract to Structural Preservation Systems in the amount of $675,542 for waterproofing work, and to authorize the City Manager to negotiate, finalize, and execute an agreement with Structural Preservation Systems.
Environmental Review
Not applicable.
Fiscal Impact
The funding for the contract is budgeted in the Fiscal Year 2025-26 Adopted Annual Operations & Capital Improvement Program Budget as building improvement costs in the Real Property Management Fund (605).
The contract award does not result in a change to the overall Real Property Management Fund Budget.

RESOLUTION NO. 2026-9546 - APPROVE AN HOURLY RATE INCREASE FOR THE FIRM OF

PROSECUTOR SERVICES, AND PROVIDING CONTINUED AUTHORIZATION FOR ATTORNEYS
AFFILIATED WITH SAID FIRM, AS WELL AS SPECIAL COUNSEL RETAINED BY THE CITY, TO INITIATE
AND TO PROSECUTE SAN MARCOS MUNICIPAL CODE ENFORCEMENT ACTIONS, WHETHER CIVIL OR
CRIMINAL
Recommendation
ADOPT resolution relating to the hourly rates for City Attorney and City Prosecutor services, and continued authorization for attorneys of the City Attorney’s firm and retained special counsel to initiate enforcement actions and to prosecute San Marcos Municipal Code violations.
Board or Commission Action
Not Applicable
Executive Summary
On January 27, 2026, the City Council appointed Council Member LeBlang as its negotiator for City Attorney compensation discussions. Said negotiator thereafter met with the City Attorney with respect to the hourly rate (s) charged to the City for legal services, and the Council has discussed the same with its negotiator. The recommendation is to increase the blended hourly rate from its current $265.00 per hour to $284.00 per hour for general legal services. The $265.00 hourly rate has been in place since 2023. The hourly rate to be charged for third party reimbursable matters would remain at 30% below the hourly rate charged by members of her firm for non-municipal work.
The City Council is also requested to reaffirm that the City Attorney’sfirm is authorized to initiate actions to enforce the San Marcos Municipal Code, and that each of the attorneys associated with her firm in any capacity are authorized to prosecute San Marcos Municipal Code violations and to raise defenses in such actions, whether by civil or criminal proceedings, on behalf of the City and its subsidiary and component units.
The request extends this authorization to other outside (special) counsel retained to assist the City.
Discussion
The attached resolution would authorize a $19.00 increase in the blended hourly rate for municipal legal services provided by the City Attorney’soffice, effective March 1, 2026. Although the initial proposal for City Attorney services accepted by the City in 1992 allows an hourly rate for litigation which is 30% below the hourly rate charged by members of her firm for their non-municipal work, as reflected in the 2023 hourly rate City of San Marcos Printed on 2/20/2026Page 1 of 2

53 File #:TMP-2396
hourly rate charged by members of her firm for their non-municipal work, as reflected in the 2023 hourly rate approval the current City Attorney has historically charged the City at the hourly rate charged for general municipal legal services rather than the rate discounted from the non-municipal work, constituting a savings to the City, and that is also memorialized in the proposed resolution. The maximum rate for experienced paralegal work will be at $200 per hour. However, the hourly rate to be charged for third party reimbursable matters will remain at 30% below the hourly rate charged by members of her firm for non-municipal work.
The City Council is also requested to continue its authorization for the Initiation of code enforcement actions and prosecutions of San Marcos Municipal Code violations by the City Attorney as City Prosecutor, as well as outside counsel retained to represent the City. The individual most suited to prosecute such matters will be assigned by the City Attorney.
Environmental Review
The activity performed under this action is not a “project”as defined under Section 15378 of the California Environmental Quality Act Guidelines (California Code of Regulations, Title 14, Division 6, Chapter 3, Sections 15000 - 15387), and is therefore not subject to environmental review pursuant to Guidelines Section 15060(c) (3).
Fiscal Impact
If approved, the impact would be a $19.00 increase in the blended hourly rate charged by the City Attorney’s Office. The proposed increase can be accommodated by the current Fiscal Year budget.

Executive Summary
The City of San Marcos owns and operates the Civic Center complex, including the City Hall Building (addressed as 1 Civic Center Drive), of which more than half of the interior square footage is leased to commercial tenants. To address aging infrastructure and accessibility concerns, maintain the building’sClass A office status, and improve wayfinding in the common areas, updates to tenant common areas are required.
These areas include the lobby, public restrooms, shared break area and patio on the third floor, hallways, and elevator lobbies.
Staff recommends awarding a contract to Safdie Rabines Architects in an amount not-to-exceed $310,000 to prepare preliminary conceptual drawings for the above-referenced work. The costs associated with this contract are included in the FY 2025-26 budget in fund 605, and award of the contract results in no change to the budget.
Discussion
The City operates a real estate portfolio as part of the fulfillment of Section 203 of the San Marcos Charter, which emphasizes enterprise activities designed to produce non-tax revenue sources. The City leases out City of San Marcos Printed on 2/24/2026Page 1 of 3

which emphasizes enterprise activities designed to produce non-tax revenue sources. The City leases out portions of floors 1 and 2, and the entirety of floors 3 and 4 of the City Hall building, the proceeds from which contributes revenue towards the City’sGeneral Fund each year. As a commercial real estate owner, the City is required to maintain the buildings and common spaces utilized by tenants and customers for safety, aesthetic, and legal/regulatory purposes.
IDS Real Estate, as the City’s real property management consultant, will be assisting with work on the building’scommon spaces utilized by tenants, visitors, employees, and members of the public such as the ground floor lobby, hallways and corridors, public restrooms, and tenant shared spaces such as the third floor breakroom and patio, workout room, and other common areas. The preliminary conceptual drawings will address a variety of issues including, but not limited to, safety and accessibility in common areas and restrooms, worn furniture, obsolete lighting fixtures, and equipment, inefficient flow by the current lobby setup, and aging infrastructure that could put the current Class A standing of the building at risk if not addressed.
To proceed with common area updates requires initial plans and specifications. Staff recommends proceeding with with Safdie Rabines architects, as it has substantial knowledge of the Civic Center building due to its history or prior work on the building, including space plans for several tenant suites, and as-bult drawings for all four floors of the building. This ensures the vendor is aware of existing conditions, systems, and constraints of the building which will also ensure lower cost to the City by minimizing the potential for future change orders and revisions of work.
As proposed by staff, the contract will include language compliant with Government Code §1097.6, and all bidders for the subsequent work will have access to the work prepared under this contract, which will allow Safdie Rabines Architects to participate in subsequent phases of the planned City Hall refurbishment work.
The FY 2025-26 budget for the project is sufficient to cover the proposed contract with Safdie Rabines Architects. Staff reviewed the proposal for the project and seeks City Council approval to award a contract for preliminary and conceptual drawings and plans to Safdie Rabines Architects in an amount not-to-exceed of $310,000, and to authorize the City Manager to negotiate, finalize, and execute an agreement with Safdie Rabines Architects.
