ACCEPT SAN MARCOS MOBILE ESTATES RENT REVIEW PETITION AND SET HEARING BEFORE THE

MOBILEHOME RENT REVIEW COMMISSION TO CONSIDER PROPOSED SPACE RENT INCREASE Recommendation
ACCEPT the City Clerk’s Certification of the rent review petition filed with respect to San Marcos Mobile Estates, SCHEDULE a hearing before the Mobilehome Rent Review Commission concerning said proposed space rent increase, recommended to occur on June 9, 2026 at 3:00 pm, and acknowledge that the City Manager or designee may reschedule said hearing in the event the parties mutually request a revised hearing date and time pursuant to Resolution 2023-9242 and revised Mobilehome Rent Review Commission Procedures.

Relevant Council Strategic Theme
Not applicable
Executive Summary
The Mobilehome Rent Review Commission (“Commission”) was established to provide a process for manufactured home owners in rental parks to request a review of proposed space rent increases from manufactured home park owners. The Commission provides a process for mobile home park owners to receive a fair and reasonable rate of return on their investments.

The City is in receipt of a mobile home park review petition from San Marcos Mobile Estates mobile home park. Pursuant to the Mobilehome Rent Review procedures, if the required number of eligible tenants have signed the petition, the City Clerk accepts the petition for filing, then forwards the petition to the Commission for the purpose of setting the hearing. In the interim, the City Clerk or his designee notifies the park owner that the proposed space rent increase is stayed until both parties agree on a proposed space rent increase, or until the Mobilehome Rent Review Commission renders a final decision on the proposed increase.

Discussion
Pursuant to City Council Resolution 2023-9242, the updated Mobilehome Rent Review Commission procedures, the hearing before the Commission must be scheduled to occur no sooner than forty-nine (49) days and no later than sixty (60) days from the receipt of the petition by the City Council. As part of this agenda item the City Council will accept the tenant petition and also set a Mobilehome Rent Review Commission hearing to consider the proposed increases.

San Marcos Mobile Estates Mobilehome Park
On January 23, 2026, the City Clerk received a notice of proposed rent increase that would go into effect May 1, 2026. A majority of the affected residents of San Marcos Mobile Estates mobilehome park signed a petition requesting a hearing before the Mobilehome Rent Review Commission on the proposed 4% space rent increase issued by the park’s owner, which was submitted to the City Clerk. Staff recommends that the City Council schedule a hearing to occur on June 9, 2026 at 3:00 pm.

The Certificate of Adequacy, which is included in this agenda packet, confirms that sixty-nine percent (69%) of the residents who are subject to the rent increase requested a rent review public hearing, exceeding the threshold for scheduling a hearing. The purpose of the hearing will be to determine whether or not the rental increase is reasonable. The park owner’s representative has been advised that the space rent increase in question is stayed until a final determination is made by the Mobilehome Rent Review Commission.

Suggested Hearing Dates
Pursuant to San Marcos Municipal Code section 16.16.070 and related Council procedures, the time frame within which to hold the hearing is between 49 and 60 days of the date of this Council meeting, or at the latest by June 13, 2026, unless a different hearing date is agreed upon by all interested parties. Staff recommends that the public hearing for San Marcos Mobile Estates be scheduled to occur on Tuesday, June 9, 2026 at 3:00 pm, and that the City Manager or designee be authorized to administratively reschedule the date in the event the parties mutually request a revised hearing date and time that is compatible with the Commissioners’ schedules. The parties are required to engage in good faith negotiations in an attempt to reach a mutual agreement prior to the public hearing.

Environmental Review
The activity performed under this action is not a “project” as defined under Section 15378 of the California Environmental Quality Act Guidelines (California Code of Regulations, Title 14, Division 6, Chapter 3, Sections 15000 - 15387), and is therefore not subject to environmental review pursuant to Guidelines Section 15060(c)(3).

Fiscal Impact
The costs associated with the Mobilehome Rent Review Commission hearings are budgeted in the approved Fiscal Year 2025- 26 budget. The costs are split between General Fund (100) and San Marcos Housing Agency Fund (Fund 250).

RESOLUTION NO. 2026-9567 -APPROVING UPDATES TO THE DESIGNATED FILER LIST TO ENSURE COMPLIANCE WITH SENATE BILL 827 (SB 827) ETHICS AND FISCAL TRAINING REQUIREMENTS Recommendation
ADOPT resolution approving designation of filers required to complete the financial literacy training as prescribed in Senate Bill 827.

Board or Commission Action
Not Applicable
Executive Summary
Senate Bill 827 (SB 827) updates and expands California’smandatory training requirements for local agency officials. The legislation modifies existing AB 1234 ethics training requirements and establishes a new statewide fiscal and financial training mandate for cities, including charter cities.

SB 827 expands the definition of “local agency official,” for ethics training purposes, to include department heads and similar administrative officers. It also requires additional fiscal and financial training for a broad range of local agency officials beginning January 1, 2026.

To ensure compliance with SB 827, staff has reviewed the City’sDesignated Filer List and recommends City Council approval of updates identifying additional positions subject to ethics training requirements, and those subject to the new fiscal and financial training requirements.

Discussion
Under existing law (AB 1234), members of a local agency legislative body, elected officials receiving compensation or reimbursement, and designated employees must complete two hours of ethics training every two years.

SB 827 makes significant changes to the AB 1234 ethics training requirements and adds fiscal and financial training requirements. These changes are discussed in more detail below.

Changes to Ethics Training Requirements
SB 827 broadens the definition of “localagency official”to include department heads and similar administrative City of San Marcos Printed on 4/9/2026Page 1 of 3

64 File #:TMP-2408
SB 827 broadens the definition of “localagency official”to include department heads and similar administrative officers of local agencies, including charter cities. Beginning January 1, 2026:
o Official appointed or elected on or after January 1, 2026 must complete ethics training within six months of assuming office.
o The two-year renewal cycle remains in effect.
o Agencies must retain ethics training records for five years. o By July 1, 2026, agencies with websites must post instructions and contact information explaining how the public may request training records.
o Officials serving multiple agencies may complete training once every two years but must provide proof to each agency.

New Fiscal and Financial Training Requirements
SB 827 establishes a new statewide requirement that certain local agency officials complete at least two hours of fiscal and financial training every two years.

For cities, this requirement applies to:
o Elected officers, and legislative body members
o Officials appointed by the City Council who make fiscal, budgeting, or public resource use decisions or recommendations
o Chief executive officers, and their assistant and deputy officers, department heads, and anyone whose position is based on an employment contract with the City o Employees designated by the City Council
Officials in service before January 1, 2026 must complete fiscal training by January 1, 2028; officials assuming office on or after January 1, 2026 must complete training within six months of assuming office. In all cases, the training is required to be completed every two years thereafter.

The training must cover fiscal administration, municipal budgeting, financial reporting, capital financing, pensions and OPEB, revenue mechanisms, investments, procurement, contracting laws, and related financial stewardship principles. The City currently has a resource in place to provide this training.

City Filers
The City’sDesignated Filer List identifies officials and employees subject to disclosure requirements under the Political Reform Act. While SB 827 is a training mandate rather than a financial disclosure requirement, implementation requires formal identification of covered positions to ensure consistent compliance tracking and governance oversight.

Staff has reviewed current classifications and recommends updating the Designated Filer List to include all the positions currently filing a Form 700 Conflict of Interest form.

The City Clerk and Human Resources will work together to ensure compliance with SB 827 by providing onboarding materials for new designated filers, tracking and retention system of training records and notifications regarding filing requirements. The City Clerk’sOffice will coordinate with Human Resources and City of San Marcos Printed on 4/9/2026Page 2 of 3

Department Directors to ensure compliance according to the law.

Environmental Review
The approval of an updated Designated Filer List is an administrative action and does not constitute a “project” under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378(b)(5), as it involves organizational or administrative activities that will not result in direct or indirect physical changes to the environment.

Fiscal Impact
SB 827 financial impacts will be absorbed within existing departmental budgets for administrative duties required from this new legislation.

RESOLUTION NO. 2026-9568 - ADOPTING POSITIONS ON LEGISLATION UNDER CONSIDERATION

PURSUANT TO THE LEGISLATIVE PLATFORM
Recommendation
ADOPT a resolution taking a position on pending legislation in the California State Legislature that may have local impacts.

Relevant Council Strategic Theme
Planning for the Future
Good Governance
Introduction
The City Council adopted the 2026 Legislative Platform to guide the consideration of state and federal bills that affect City operations. Legislators introduced approximately 1800 bills. Staff, lobbyist consultants and Cal Cities continue to review this new legislation. Many of these bills were “spot bills,” meaning that they only contain legislative intent, and are starting to be amended. The deadline for policy committees to hear bills introduced in the first house is April 24, 2026. 2026 is also an election year, and the final year in Governor Newsom’s term.

Discussion
This report provides updates on early legislation of concern in the second year of this legislative session. Staff continue to monitor these bills, and others as the legislative session continues. They will also collaborate with Cal Cities and our lobbyist teams on future City Council consideration for official positions on bills working their way through the legislative process.

Important dates in the legislative calendar:
· April 24 - Policy committee deadline.

The following bills best align with the City’s state legislative priorities, and staff believe that they would have a possible impact on the city.

The proposed action does not constitute a “project” as defined under Section 15378 of the California Environmental Quality Act Guidelines (California Code of Regulations, Title 14, Division 6, Chapter 3, Sections 15000 - 15387), and is therefore not subject to environmental review pursuant to Guidelines Section 15060(c) (3).

Fiscal Impact
There is no direct fiscal impact associated with adopting the proposed resolution. Unknown fiscal impacts are associated with the bills noted in Attachment A. A more thorough analysis of each bill’s implementation requirements is needed to demonstrate total fiscal impact.

RE: AB 1564 (Ahrens) Employer-employee relations: confidential communications. (As Amended February 25, 2026)

Dear Assemblymember Wicks,

The City of San Marcos respectfully expresses its opposition to AB 1564 (Ahrens), which would prohibit a public employer from questioning a public employee, a representative of a recognized employee organization, or an exclusive representative regarding communications made in confidence between an employee and an employee representative in connection with representation relating to any matter within the scope of the recognized employee organization’s representation. The bill would also prohibit a public employer from compelling a public employee, a representative of a recognized employee organization, or an exclusive representative to disclose those confidential communications to a third party.

The requirements of this bill could limit the city’s ability to fully investigate workplace issues if we can’t ask about certain communications. While the city appreciates Assemblymember Ahrens’ desire to protect employee communications with their union representatives, this is not the way to do it.

These restrictions are overly broad, and could greatly limit how and when a city, like San Marcos, can have this type of discussion with staff.

The city of San Marcos supports the ability of represented employees to have candid, frank and protected discussions with a representative of their employee organization. The city of San Marcos believes the bill would add excessive additional restrictions to how cities can discuss this type of communications with represented staff, without additional benefits.

For these reasons, the City of San Marcos must oppose AB 1564 (Ahrens).

Sincerely,

Rebecca D. Jones
Mayor

RE: AB 1995 (Patel) State Fire Marshal: lithium battery working group: membership: funding. (As Introduced February 17, 2026)

Dear Assemblymember Ransom,

The City of San Marcos respectfully expresses its support of AB 1995 (Patel), which would make moneys in the Building Standards Administration Special Revolving Fund available, upon appropriation, to support the lithium battery working group. The bill would also appropriate an unspecified amount from the fund for specified purposes related to addressing building safety concerns associated with lithium batteries and associated charging infrastructure being installed or used near or within residential or commercial occupancies.

In 2025, Assemblymember Patel introduced AB 841, which was signed by the Governor, which created a working group to identify those safety issues associated with lithium batteries and associated charging infrastructure installed or used near or within residential or commercial occupancies.

The San Marcos Fire Department, and other fire departments throughout the state are responding to more lithium battery fires. These fires expose firefighters to more carcinogens and leave a chemicals on their turnout gear that are difficult, if not impossible to remove.

The City of San Marcos believes that it is critical to ensure firefighters have the appropriate personal protective equipment and protocols to reduce exposures and minimize health risks. While the working group has been created, it requires funding to research these important issues.

For these reasons, the City of San Marcos supports AB 1995 (Patel).

Sincerely,

Rebecca D. Jones

RE: AB 2179 (Patel) Workplace violence: restraining orders. (As Introduced February 19, 2026)

Dear Assemblymember Wicks,

The City of San Marcos respectfully expresses its support of AB 2179 (Patel), allow any party or witness to a petition for a restraining order to appear remotely at a hearing and would prohibit any fee for appearing remotely. The bill would require the court of each county to develop rules and instructions for such remote appearances and post them on its website. The bill would also require courts to allow filings related to such protective orders to be submitted electronically, as specified.

This bill aligns with the city’s current workplace violence prevention efforts and would make it easier for individuals to appear at restraining order hearings and assist employees by making filings easier.

Additionally, this bill would align workplace violence restraining orders to make them conform with how other restraining orders are filed. It is important to provide the same opportunities to file petitions electronically and allow parties and witnesses to appear remotely

The City of San Marcos supports stronger workplace violence protection efforts for its employees and making it easier for them to appear remotely at hearings. The City of San Marcos believes the bill would reduce practical barriers to participation, ensure the court receives the information it needs while minimizing disruption to work and reducing safety risks for parties and witnesses.

For these reasons, the City of San Marcos supports AB 2179 (Patel).

Sincerely,

Rebecca D. Jones

RESOLUTION NO. 2026-9569 - CONFIRMING ANNULMENT OF A PRIOR CONTRACT AWARD FOR THE 2026 PARKS ELECTRICAL UPGRADES PROJECT, AWARDING THE CONTRACT TO THE NEXT LOWEST RESPONSIVE AND RESPONSIBLE BIDDER SELECT ELECTRIC, INC.

Recommendation
ADOPT a resolution confirming annulment of a prior contract award for the 2026 Parks Electrical Upgrades Project, awarding the contract to the next lowest responsive and responsible bidder Select Electric, Inc. in an amount not to exceed $753,169.00, and delegating to and authorizing the City Manager to negotiate, finalize, and execute the contract and all related documents.

Board or Commission Action

Relevant Council Strategic Theme
Improving Public Safety
Investing in Infrastructure and Energy Efficiency
Good Governance
Executive Summary
The Public Works Department currently maintains 44 city parks throughout San Marcos. Staff recently evaluated park lighting systems and developed a prioritized list of needed improvements. Based on that evaluation, staff publicly solicited and received bids for lighting improvements at five park locations. Following annulment of the Notice of Award issued to the apparent low bidder for failure to timely provide the required documentation and execute the agreement, approval of this resolution will award a contract to Select Electric, Inc. for lighting improvements at Civic Center Park, Foothills Park, San Elijo Park, The Laurels Park, and Valley View Park in an amount not to exceed $753,169.00.

Discussion
Park lighting is a key safety and usability feature across the City’s park system. The 2026 Parks Electrical Upgrades Project will replace and upgrade aging lighting infrastructure to improve visibility, reliability, and overall park operations at Civic Center Park, Foothills Park, San Elijo Park, The Laurels Park, and Valley View Park.

The existing lighting systems at these locations require replacement to support continued, reliable service.

In accordance with Section 2.30.100 of the San Marcos Municipal Code, bids were publicly solicited under PW CONBID 25-02 on January 23, 2026, and bids were received on February 17, 2026. The apparent low bidder failed to timely provide the required documentation and execute the agreement as required by the Notice of Award and Invitation for Bids. Accordingly, the Notice of Award was annulled, and said contractor was notified accordingly. Select Electric, Inc. is the next lowest responsive and responsible bidder.

Staff recommends that the City Council confirm annulment of the prior award of the contract for the 2026 Parks Electrical Upgrades Project, award said contract to Select Electric, Inc., in an amount not to exceed $753,169.00, and authorize the City Manager to negotiate, finalize, and execute the contract and all related documents with replacement contractor Select Electric, Inc.

Environmental Review
The activity performed under this action is not a “Project” as defined under Section 15378 of the CEQA Guidelines, and is therefore not subject to environmental review pursuant to CEQA Guidelines section 15060 (c)(3).

Fiscal Impact
Funding for the project is appropriated in the FY 2026 City Infrastructure Replacement / Rehabilitation Fund (604). The contract award does not commit the City to any future expenditure beyond the approved contract amount.

RESOLUTION NO. 2026-9570 - APPROVING CONSTRUCTION DOCUMENTS AND APPROPRIATING ADDITIONAL FUNDS FOR THE ADAPTIVE TRAFFIC CONTROL SYSTEM PROJECT (CIP #TR005) Recommendation
ADOPT a resolution to approve the construction documents, delegating authority to the City Engineer to finalize the same, and appropriate additional funds for the Adaptive Traffic Control System Project (CIP #TR005).

Board or Commission Action
Not Applicable
Executive Summary
The Adaptive Traffic Control System Project (Project) will implement adaptive traffic control systems (ATCS) to the signalized intersections on Nordahl Road from Center Drive to Mission Road. City staff recommend the City Council approve the construction documents and appropriate additional funds necessary for the construction of the Project. Construction Documents are on file with Development Services.

Discussion
The project was initially funded in fiscal year 2019-2020 to study ATCS within the City and implement within the Nordahl Road corridor. As the project development progressed, it was determined that the project would benefit by including the Caltrans ramp intersections for SR-78 to increase the efficacy of the ATCS. In late 2025, after several years of discussions with Caltrans, Caltrans agreed to the installation of ATCS on their ramp signals along the Nordahl corridor.

Due to rising construction costs over the years and the inclusion of the Caltrans intersections, additional funds are required for the project. To minimize the cost increases, staff has procured the higher priced materials from existing vendors to implement the ATCS which avoids the typical markup included by the Contractor.

Additionally, the construction will be performed by a Contractor already procured through an on-call contract with Public Works.

Staff recommends that the City Council approve the construction documents, that it authorize the City Engineer to finalize the same, and appropriate additional funds for the Project as described in the Fiscal Impact discussion, below.
