RESOLUTION NO. 2026-XXXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, CALIFORNIA, APPROVING WITHDRAWAL FROM THE PUBLIC AGENCIES SELF-INSURANCE SYSTEM (PASIS), APPROVING THE AGREEMENT FOR WITHDRAWAL FROM PASIS MEMBERSHIP, AND AUTHORIZING THE CITY MANAGER TO EXECUTE DOCUMENTS NECESSARY TO EFFECTUATE THE WITHDRAWAL WHEREAS, the City of San Marcos (City) currently participates in the Public Agencies Self-Insurance System (PASIS) for workers' compensation coverage and related risk management services; and WHEREAS, staff completed a best value analysis of the City's workers' compensation program and determined that consolidating workers' compensation coverage, claims administration, and risk management services under the California Joint Powers Insurance Authority (CJPIA) would provide operational efficiencies and streamlined service delivery; and WHEREAS, on May 26, 2026, the City Council adopted Resolution No. 2026-9599 authorizing participation in the California Joint Powers Insurance Authority Excess Workers' Compensation Protection Program effective July 1, 2026; and WHEREAS, to complete the transition to CJPIA, the City must formally withdraw from PASIS and enter into an Agreement for Withdrawal from PASIS Membership establishing the terms and conditions of withdrawal, the content of which has been successfully negotiated with PASIS; and WHEREAS, pursuant to the Withdrawal Agreement, open workers' compensation claims incurred during the City's participation in PASIS will transfer to CJPIA for continued administration, while the City will retain responsibility for liabilities associated with such claims; and WHEREAS, the City Council has reviewed the proposed Agreement for Withdrawal from PASIS Membership and finds that approval of the Agreement is in the best interests of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Marcos as follows:
The City Council hereby approves withdrawal from the Public Agencies Self-Insurance System (PASIS) effective July 1, 2026.
The City Council hereby approves the Agreement for Withdrawal from PASIS Membership between PASIS and the City of San Marcos in substantially the form presented to the City Council, authorizing the City Manager to make minor, non-material corrections or modifications prior to execution.
The City Manager, or designee, is hereby authorized and directed to execute the Agreement for Withdrawal from PASIS Membership and any related agreements, notices, certificates, or other documents necessary to effectuate the City's withdrawal from PASIS and its transition to the CJPIA.
