RESOLUTION NO. 2026-XXXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS DELEGATING TO AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE, FINALIZE, AND EXECUTE CONTRACT AMENDMENTS FOR THE 2026 SURFACE SEAL PROJECT (CIP# ST011-2) Whereas, the 2026 Surface Seal Project (Project) is a construction project to repair and maintain pavement and other improvements within the City of San Marcos; and Whereas, the City Council approved the construction documents and delegated authority to the City Manager to award, finalize, and execute the construction contract documents for the Project on February 24th 2026; and WHEREAS, due to ongoing pavement deterioration following contract award the City will revise and increase the pavement repair and preservations limits and methodology for portions of the Project to avoid delays in repairing the road; and WHEREAS, several Vallecitos Water District (VWD) water line breaks occurred on roads that are included in this year’s surface seal project which require localized road repairs; and WHEREAS, in an effort to streamline construction activities and reduce impacts to the public, the City is partnering with VWD to address these road repairs under an existing cost sharing agreement in which VWD will reimburse the City for the costs associated for these road repairs done by the City’s contractor relating to these water line breaks; and Whereas, the Project budget has sufficient funds to accommodate these additional roadway repair costs; and WHEREAS, the purchasing provisions of Chapter 2.30 of the San Marcos Municipal Code permit the City Manager to authorize change orders for a contract up to ten percent of the original contract amount; and WHEREAS, this additional work will exceed the City Manager’s authority under the San Marcos Municipal Code.
NOW, THEREFORE, BE IT RESOLVED as follows:
The City Council hereby delegates to and authorizes the City Manager to negotiate, finalize, and execute amendments to the construction Contract in excess of ten percent limit contained in the San Marcos Municipal Code section 2.30.030(c), provided that no combination of such amendments of the Contract or other allocated expenses will exceed the approved and appropriated Project budget.
