STRATEGIC PLAN CRITICAL SUCCESS FACTORS
• Efficient, Responsive, and Effective City Services
• Fiscally Responsible and Transparent City Government
BACKGROUND
The City’s Parks & Public Works Director/City Engineer is leaving San Marino on April 1, 2022.
This role is critical in our organization and we are conducting an executive search to find a suitable replacement. Appointing an Interim Director is standard practice in situations like this.
Under those California laws that govern public sector retirements, a retired annuitant may be employed by a CalPERS agency for no more than 960 hours in a fiscal year, and may be paid no more than a regular employee in the same capacity. Government Code 21221(h) also provides that such an agreement must be adopted by resolution of the City Council.
In addition to the CalPERS requirement for a legislatively-approved resolution, the San Marino Municipal Code requires the City Council to concur with any department head hired by the City Manager, even in an interim capacity.
DISCUSSION
I am prepared to appoint Mr. Robert Newman to the role of Interim Parks & Public Works Director/City Engineer. He is extremely well-known and well-respected in the field, having retired late last year from the City of Santa Clarita after a total of 27 years with the last almost 20 of those as Director. In addition, he was the Public Works Director/City Engineer for the City of Calabasas for three years and also worked for the City of Pasadena and the County of Los Angeles earlier in his career. He is a Professional Engineer (PE), has a bachelor’s degree in civil engineering, and has been very involved in the industry over the course of his career TO: Mayor and City Council

SUBJECT: ADOPTION OF RESOLUTION NO. R-22-16, APPROVING THE
APPOINTMENT OF A RETIRED ANNUITANT TO THE POSITION
OF INTERIM PARKS & PUBLIC WORKS DIRECTOR/CITY
ENGINEER

including the receipt of several professional awards and holding many regional leadership positions.
If approved by the City Council, his interim appointment will begin on Thursday, March 31, 2022 in order to effectuate the transition. Although the arrangement may be terminated at any time by either party, the interim appointment is expected to conclude when a “permanent” replacement joins us, in no case later than December 31, 2022.
FISCAL IMPACT & PROCUREMENT REVIEW
It is expected that Mr. Newman will work approximately 30 hours per week. The terms of the appointment include only the hourly rate equivalent of the top step of the salary range; no other benefits are permitted, per CalPERS regulations. The hourly rate for the Parks & Public Works Director/City Engineer is $87.58. CalPERS regulations limit retired annuitants to 960 hours per fiscal year and, even if Mr. Newman works the full number of allowable hours, it will not exceed funds already budgeted for this position. As a result, no additional appropriation of funds is necessary.
LEGAL REVIEW
The City Attorney has reviewed this item.
RECOMMENDATION
Staff recommends the City Council concur with the City Manager’s appointment of Mr. Robert Newman as Interim Parks & Public Works Director/City Engineer and approve Resolution No.
R-22-16. If the City Council concurs with staff’s recommendation, an appropriate motion would be:
“I move to concur in the City Manager’s appointment of Mr. Robert Newman as Interim Parks & Public Works Director/City Engineer by approving Resolution No. R-22-16.”
