BACKGROUND
Sections 02.03.04, 02.03.07, and 02.04.02 of the San Marino Municipal Code (SMMC) authorize the City Manager to appoint and remove department heads from office, but only with the concurrence of the City Council. Specifically, SMMC §02.04.02(B) states, “All department heads shall be ‘at will employees,’ serving at the pleasure of the City Manager. The hiring or discharge of department heads shall be subject to concurrence by the Council…” On November 8, 2017, the City Council confirmed its desire to continue this practice.

DISCUSSION
The City’s former Human Resources Manager left the City’s employ in September 2021 for a promotion in a larger city. We conducted a recruitment to fill that position, but were unsuccessful in finding an appropriate candidate. In December 2021, the City Council approved a Human Resources Director position to replace the Human Resources Manager position. The City recruited again for this higher level position. The City Council concurred in the appointment of the successful final candidate, and he began employment on April 11, 2022.

Unfortunately, he resigned, effective immediately, on his third day of employment.

2 Having previously retained the executive search firm of Bob Hall and Associates to conduct our Parks & Public Works Director recruitment, I repurposed that search toward Human Resources Director. I am delighted to report that we believe we’ve found a successful candidate, interviewed by human resource experts, the Executive Team, and myself. We are currently conducting background checks on the selected candidate and expect to have that successfully concluded by the City Council’s meeting on June 24, 2022. If concurrence is received by the City Council, we expect that the selected candidate would come aboard on Monday, August 1, 2022.

In the meantime, Finance Director Paul Chung has been serving in the capacity of Acting Human Resources Manager and Director since September 2021 and is expected to continue in that role until August 2022, at which point we hope our successful candidate will begin employment with us. This will be a total of approximately eleven months.

Director Chung took over the responsibilities with good spirits and no additional compensation whatsoever. As the assignment has progressed, it has become apparent that the ongoing duties and responsibilities associated with managing the operations of a second department warrants additional compensation. As a result, and as discussed previously with the City Council, I am recommending that Director Chung be provided additional compensation of $12,500 per pay period for the additional duties and services he will perform for the duration of the temporary assignment, in a total amount not to exceed $25,000, which is the approximate equivalent of an additional 15% of pay. This special pay will commence with the pay date of July 8, 2022.

FISCAL IMPACT & PROCUREMENT REVIEW
No additional appropriations are necessary for these recommendations. The position of Human Resources Director is already accounted for in the FY 2022-23 budget. The $25,000 compensation for Finance Director Chung will be mostly absorbed by the salary savings yielded by the Human Resources Director vacancy (approximately $17,345 for the one month of FY 2022-23, although we have additional significant savings over the 11 month vacancy period occurring in FY 2021-22); the remainder will be absorbed by cost savings throughout the year.

LEGAL REVIEW
The City Attorney’s Office has reviewed this report and approved it as to form.

RECOMMENDATION
If the City Council concurs with staff’s recommendation, an appropriate motion would be: “I move that the City Council concur with the City Manager on the hiring of _______________

Page 6 of 24 ends

3 as Human Resources Director for the City of San Marino and to provide additional compensation to the Acting Human Resources Director in an amount not-to-exceed $25,000.”

BACKGROUND
The General Municipal Election will be held on November 8, 2022 for the purpose of electing three (3) members to the City Council for four-year terms. The three (3) incumbent members of the City Council are Susan Jakubowski, Gretchen Shepherd Romey, and Ken Ude. Prior to the holding of an election, the City must adopt three resolutions in relation thereto. The first resolution calls and gives notice of holding an election. The second resolution requests the Los Angeles County Board of Supervisors to allow consolidation with the Statewide election being held on the same day and to direct the County Elections Department to render services. The third resolution adopts regulations for the candidates’ statements.

DISCUSSION
Significant dates for the General Municipal Election are as follows:
• July 18, 2022 – Filing period opens for nomination papers • August 12, 2022 – Last day to file nomination papers
• August 17, 2022 – Last day to file nomination papers should an incumbent not file • August 18, 2022 - Secretary of State to determine Order of Names on Ballot • October 24, 2022 – Last day to register to vote for this election • November 8, 2022 – ELECTION DAY

Resolution No. R-22-26 “Calling and Giving Notice” must be submitted to the County no later than 120 days prior to the election (July 11, 2022). This resolution is to call the City’s General Municipal Election to elect three City Council members. The resolution includes language that would allow - but not require - the City to submit a ballot measure or measures to the voters at the same election.

Resolution No. R-22-27 requests the Board of Supervisors to consolidate the City’s election with other elections on the same date the County will conduct and to permit the County Elections Department to take any and all steps necessary for the holding of the election. The services to be provided by the County Registrar of Voters include, but are not limited to, the appointment of all required election officers and establishment of polling places; publishing the notice of appointment of election officers, preparing and mailing the official and sample ballots including candidates’ statements, process vote by mail ballots; supply all needed materials for polling places; conduct the election, canvass the election returns and certify the results; and in the event of a tie vote between two or more persons receiving an equal and the highest number of votes for the offices to be voted for, to determine the tie by lot. The City would reimburse the County for the costs of providing the services.

Resolution No. R-22-28 adopts regulations for candidates pertaining to candidates’ statements submitted to the voters. The regulations limit the candidate’s statement to 200 words describing the candidate’s education and qualifications expressed by the candidate. The statement shall not include party affiliation nor membership or activity in partisan political organizations. The candidates will be required to pay a deposit of $300 at the time of filing his/her nomination paper in order to have the statement included in the voters’ pamphlet. The candidate will be billed for any cost in excess of the deposit and will receive a refund of any unused portion of the deposit.

This is in addition to a filing fee of twenty-five dollars ($25) which shall be paid by the candidate upon the filing of nomination papers.

FISCAL IMPACT & PROCUREMENT REVIEW
The County’s Election Estimating Calculator has provided an estimate of the cost for this election which is approximately $66,300. The funds have been included in the fiscal year 2022-23 budget.

There is not a viable alternative to contracting with the County for these services.

LEGAL REVIEW
The City Attorney’s office has reviewed and approved as to form.

RECOMMENDATION
Staff recommends the Council adopt Resolution No. R-22-26, Resolution No. R-22-27, and Resolution No. R-22-28. If the City Council concurs with staff’s recommendation, an appropriate motion would be:
“I move to adopt Resolution No. R-22-26, calling and giving notice of the holding of a general municipal election to be held on Tuesday, November, 8, 2022; Resolution No. R-22-27,
