ADOPTION OF RESOLUTION NO. R-24-36 DELEGATING
CLAIMS SETTLEMENT AUTHORITY TO THE CITY MANAGER
STRATEGIC PLAN CRITICAL SUCCESS FACTORS
Efficient, Responsive, and Effective City Services
Fiscally Responsible and Transparent City Government
BACKGROUND
The City of San Marino is a member of the California Joint Powers Insurance Authority (“CJPIA”). By virtue of that participation, the handling of certain claims against the City have been delegated to CJPIA. Evaluation and settlement of other non-CJPIA covered claims are subject to approval by the City Council and the City Manager, where authority has been delegated to the City Manager. San Marino Municipal Code section 2.06.03(E) delegates $500 in authority to the City Manager. All other claims must be presented to the City Council for resolution.
DISCUSSION
Certain claims against the City are not covered by CJPIA, such as workers compensation claims, certain contract disputes, and claims for refunds of certain fees. The San Marino Municipal Code delegates $30,000 of authority Steven W. Huang, DDS, Mayor
Gretchen Shepherd Romey, Vice Mayor
Tony Chou, Council Member
Calvin Lo, Council Member
Steve Talt, Council Member
to the City Manager for purchasing and contracting.
For ease of administration and efficiency in the resolution of claims against the City that are not otherwise covered by CJPIA, it is recommended that the Council delegate authority to pay/settle claims up to $30,000, commensurate with his purchasing/contracting authority.
The attached ordinance will revise the San Marino Municipal Code to allow the City to set the City Manager’s claims payment authority via resolution. The attached resolution will set that claims payment authority for non-CJPIA covered claims at $30,000, effective upon the effective date of the attached ordinance.
FISCAL IMPACT & PROCUREMENT REVIEW

RECOMMENDATION
Staff recommends the City Council introduce for first reading Ordinance No.
O-24-1417 amending San Marino Municipal Code section 2.06.03 and approve Resolution No. R-24-36, delegating $30,000 in settlement/claims payment authority to the City Manager for non-CJPIA covered claims. If the City Council agrees, an appropriate motion would be:
“I move to introduce Ordinance No. O-24-1417, an Ordinance of the City Council of the City of San Marino Amending San Marino Municipal Code Section
2.06.03 Pertaining to the City Manager’s Authority to Pay Claims for first reading by title only and waive further reading; and approve Resolution No.
R-24-36.”
