BACKGROUND
The City of San Marino and the San Marino Tennis Foundation (Foundation) have an existing Concession Agreement, which originated to facilitate the operation of six tennis courts constructed by the Foundation on City-owned property in 1969. Under the terms of the Agreement, the Foundation agrees to maintain and operate the facility, which consists of tennis courts, as well as fencing, landscaping, a pro shop, court lighting, and restrooms. In exchange for maintaining and operating the facility, the Foundation collects fees, membership dues, and other facility-related revenues. The current Agreement, approved by City Council in 2017, is due to expire on December 31, 2024. As the Foundation has been compliant with the terms of the Agreement, staff recommends extending the term for two (2) additional years through December 31, 2026.

DISCUSSION
The City and the Foundation have found the existing Agreement to be sufficient, and both parties have complied with the terms of the Agreement.

As such, no changes to the Agreement are proposed at this time, beyond extending the term for two (2) additional years through December 31, 2026.

RECOMMENDATION
Staff recommends that the City Council approve an Amendment to the Concession Agreement with the San Marino Tennis Foundation, extending the term of the Agreement for two (2) additional years through December 31, 2026. If the City Council concurs, an appropriate motion would be:
“I move to approve an Amendment to the Concession Agreement with the San Marino Tennis Foundation, extending the term of the Agreement for two (2) additional years through December 31, 2026, with final language subject to approval by the City Manager and City Attorney and authorize the City Manager to execute the Amendment.”
