BACKGROUND
On November 13, 2024, the City Council conducted a public hearing to review and take public comment on the proposed Ordinance. The City Council unanimously voted 5-0 on a motion to waive full reading and introduce by title only Ordinance No. O-24-1416 with amendments to cite proper government code sections and correct clerical errors.
DISCUSSION
Staff has prepared Ordinance No. O-24-1416, inclusive of amendments to cite proper government code sections and correct clerical errors (Attachment No. 1), which would amend Municipal Code Sections 23.01.01 (Definitions) and 23.02.25 (Accessory Dwelling Units) to be consistent with State accessory dwelling units and junior accessory dwelling units laws.

FISCAL IMPACT & PROCUREMENT REVIEW
Apart from the reallocation of staff resources needed to address this matter, there is no new financial impact.
LEGAL REVIEW
The City Attorney's office has reviewed and approved as to form.
RECOMMENDATION
Staff recommends the Council adopt Ordinance No. O-24-1416. If the City Council concurs with staff’s recommendation an appropriate motion would be:
“I move to adopt Ordinance No. O-24-1416, an Ordinance of the San Marino City Council amending Municipal Code Sections 23.01.01 and 23.02.25 to implement State law regarding accessory dwelling units.”
