THEREFORE, BE IT RESOLVED by the City Council of the City of San Marino, California, as follows:

SECTION 1. The City Council hereby declares that the recitals set forth above are true and correct, and incorporated into this resolution as findings of the City Council.

SECTION 2. The City of San Marino City Council amends the General Plan to incorporate the Final 2021-2029 (Sixth Cycle) Housing Element Update attached to the November 13, 2024 City Council staff report.

SECTION 3. The City of San Marino City Council approves the amendments to the City’s General Plan Land Use Map attached to the November 13, 2024, City Council staff report to ensure consistency between the City’s Municipal Code, General Plan, and Final 2021-2029 (Sixth Cycle) Housing Element Update.

SECTION 4. The City of San Marino City Council finds, based upon the whole record, there is no evidence that the project will have a significant effect on the environment. The actions covered by this Resolution have been fully analyzed and mitigated to a less than significant level in the Addendum to an adopted Negative Declaration (SCH 2022010208) for the 2021-2029 Housing Element adopted by the City Council on November 13, 2024, and none of the conditions described in CEQA Guidelines Section 15162 requiring subsequent CEQA review have occurred.

SECTION 5. State Planning and Zoning Law requires the Housing Element to identify adequate sites to accommodate the City's Regional Housing Needs Assessment (RHNA) for all income categories, and the Housing Element Update identifies sites that can accommodate housing exceeding the City's RHNA. Pursuant to Government Code Section 65583.2(g)(2), and as set out in detail in the 2021-2029 Housing Element, based on substantial evidence the nonvacant sites identified in the RHNA sites inventory are suitable for residential development, and that the existing uses on the nonvacant sites do not constitute an impediment to additional residential development and are likely to be discontinued during the planning period, based on factors including continued decline of commercial uses, age and condition of existing buildings, COVIDimpacted uses, and general development trends of commercial uses on nonvacant sites converting to new mixed-use and residential uses in the Mixed-Use designated areas.

SECTION 6. Severability: If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Resolution is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Resolution. The City Council hereby declares that it would have adopted this Resolution and each and every section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared unconstitutional.

SECTION 7. Effective Date: This Resolution shall become effective immediately upon adoption.
